Ref: Whistle-blower corruption and right to life Writ Petition pending
in the Delhi High Court since February 2012 - Writ Petition (Civil)
1280/ 2012 - in the matter of Seema Sapra v General Electric Company &
Others AND request that the Chief Justice of India be apprised of this
matter AND request that this matter be transferred to the Supreme
Court of India for hearing.


I am an advocate enrolled with the Bar Council of Delhi since 1995.

I have filed the captioned corruption petition producing complaints
and evidence of corruption, fraud, forgery, bribery and other illegal
practices committed by General Electric Company, its subsidiaries, its
employees and agents in connection with two Railway Ministry tenders
for Projects to set up diesel and electric locomotive factories at
Marhowra and Madhepura respectively. These two Projects with long term
purchase and service contracts are together worth over Rs 127,000
crores to the selected bidder. Not only are these Projects against the
national and public interest but as described by me in the writ
petition these tenders and Projects are tainted with corruption,
illegal lobbying, fraud, forgery, and bribery with high level
Government of India functionaries including Montek Singh Ahluwalia
conspiring with General Electric to create and award these lucrative
tenders and Projects to General Electric.

I had in an earlier email dated 25 March 2014, brought to your
attention the names of Judges of the Delhi High Court who cannot hear
this and two other connected matters (i.e., OMP 647 of 2012 and
Criminal Contempt Case 3 of 2012).

The reasons why the following judges cannot hear WP Civil 1280 of
2012, OMP 647 of 2012, and Criminal Contempt Case 3 of 2012 are listed
below;

I have been poisoned since 2010 and continue to be poisoned. I fear
for my life and will be murdered unless these matters are taken up
expeditiously and unless I am protected.

I reproduce below the order passed in WP Civil 1280 of 2014 on 23
April 2014 by Justice S K Misra and Justice S P Garg:

"Today the petitioner, who appears in person, states as follows:

"I have claimed a grave threat to my life from the State including
the police. I have informed this Court in writing that since January
2014. I have been sleeping in my car outside Gate No.8 of the Delhi
High Court. I have also been informing this Court in writing and
through affidavits filed in this matter that the police has failed to
comply with the protection orders issued by this Court; and that I am
not only being harassed and targeted with police complicity during the
night but I am also being poisoned by deliberate exposure to toxic
chemical, including nerve agents and organophosphates, during the
night. I fear for my life. I have been waking up breathless during the
night on account of such poisoning, and I apprehend that if this
continues, it will result in cessation of breathing and will cause
death; and I further apprehend that the police will then be used to
cover up such murder. I have been making police complaints about these
incidents since January 2014 in writing but the police has failed to
even respond to these complaints. In view of this, I am making an oral
request to this Hon?ble Court that it issue the directions to the
Registrar General of this Court; to the Delhi Police Commissioner; and
to the local SHO; to ensure that the CCTV security camera recordings
maintained both by the Court and by the police in the area where I am
parking my car at night and along the roads leading to that spot; be
preserved, because this will be valuable evidence in support of my
complaints to the police. I have been informed by the Delhi Police
security that such recordings are normally preserved only for a month.

I am, therefore, seeking directions from this Court that these
recordings be preserved for longer than that until my complaints are
addressed and investigated. I am also submitting that such an order
will also result in providing me some measure of protection because
those harming me, including the police, will get the message that the
evidence of what is going on around my car during the night is being
preserved pursuant to the directions of this Court. This is my request
orally.

Further, I have also requested the Hon'ble Court to direct the
Registrar General to preserve CCTV footage from the three court
lobbies today because I noticed that a policeman was instructing two
other policemen to target me; and CCTV footage might provide evidence
of contact between the General Electric lawyers and those policemen.
Further, one Sub Inspector Umed Singh from Police Station Nizamuddin,
who is present in Court, was also seen by me speaking with General
Electric lawyers outside the Court."

We have recorded the above verbatim so that there may be no doubt
about the submissions of the petitioner, who also happens to be a
qualified and practicing Advocate registered at the Bar.

This matter has been pending for some time. There is extensive
controversy raised by the petitioner on almost every aspect of the
matter. Apparently, she is also making serious allegations against the
respondents including the Police Authorities to the extent of alleging
a deliberate intent to murder her in a premeditated conspiracy.

Under the circumstances, it is open to the petitioner to file an
appropriate application seeking specific reliefs so that an
appropriate response can also be obtained from the concerned
respondents on every allegation made by the petitioner. As and when
such an application is moved, the same shall be duly considered by
this Court.

We have now invited the petitioner to continue where she left off on
the previous date of hearing.

We have heard the petitioner from 3:50 PM to 5:31 PM.

Re-notify on 24.04.2014 at 3:30 PM."


I repeat my request that these matters be brought to the attention of
the Chief Justice of India with a request that the Chief Justice of
India transfer these matters to the Supreme Court of India for
hearing. I repeat and reiterate the contents of my letter addressed to
the Chief Justice of the Delhi High Court dated 10 January 2014.

On several earlier occasions, registry officials including listing
Registrar Lorren Bamniyal have in corrupt collusion with lawyers
representing General Electric (without proper authority documents),
conspired to mislead the Chief Justice of the Delhi High Court and
have got this matter listed before Benches which are disqualified from
hearing this matter. For instance, in March 2014, WP Civil 1280 of
2012 was listed before a Bench comprising of Justice Najmi Waziri who
earlier appeared in this matter as counsel for the Delhi Police
Commissioner. Also on 29 April 2014, WP Civil 1280 of 2012 was listed
before Justice Shali even though his spouse's BHEL shares disqualified
him. BHEL is a respondent in WP Civil 1280 of 2012 and was a joint
bidder with General Electric and the grant of relief prayed for in the
writ petition would also result in penalties for BHEL.

The fraudulent and unauthorized OMP 647 of 2012 purporting to have
been filed on behalf of GE India as part of the conspiracy to subvert
the administration of justice in my whistle-blower corruption writ
petition against General Electric Company was listed on 29 April 2014
before Delhi High Court Judge Vipin Sanghi. I informed the Judge that
he ought not to hear this matter because there were existing registry
directions in WP Civil 1280 of 2012 (a connected matter) that that
matter not be placed before Judge Vipin Sanghi as his relative, a
lawyer called Anupam Sanghi has issued threats in 2011 to me on
instructions from GE lawyers including telling me that if I approached
a court with my complaints against General Electric, then I would find
that "judges were harassing me".

I find it surprising that despite my communications to the Chief
Justice of the Delhi High Court and the Registrar General of the Delhi
High Court setting out the objection to these connected matters being
listed before Justice Vipin Sanghi, OMP 647 of 2012 was again listed
before J. Vipin Sanghi.

I pointed out the above to Justice Vipin Sanghi and he has directed
OMP 647 of 2012 to be placed before a different Bench on 12 May 2012.

I also point out that WP Civil 1280 of 2012 was listed in the Delhi
High Court before a Division Bench of Justice Shali and Justice G P
Mittal on 29 April 2014.

I also find it surprising that despite my communications to the Chief
Justice of the Delhi High Court and the Registrar General of the Delhi
High Court setting out the objection to these connected matters being
listed before Justice Shali, WP 1280 of 2012 was listed before a
Division Bench comprising of J. Shali.

I have earlier made complaints about how Ms Rita Kaul was targeting me
on the instructions of Mr A S Chandhiok, how she attempted to
fraudulently obtain my signatures on a piece of paper, and how she
told me that if I authorised her in writing, she could speak to
Justice Gita Mittal "for me" before whom WP Civil 1280 of 2012 was
then listed. This "offer" was entirely unsolicited from my side. Rita
Kaul has close family ties to Justice Shali and I had overheard her
state in the ladies bar room, that her daughter was married into
Justice Shali's family. She added that her daughter was married to the
son of Justice Shali's real brother. Given Rita Kaul's past conduct
concerning WP Civil 1280 of 2012 and my complaints against Rita Kaul,
which are on the court record of WP Civil 1280 of 2012, it was
inappropriate for Justice Shali to hear this matter given his close
family ties to Rita Kaul.


Further, it came to my notice that Justice Shali's spouse and child
both hold shares of BHEL. BHEL is a party in WP Civil 1280 of 2012 and
its financial outlook and share price is liable to be affected by the
final decision in WP Civil 1280 of 2012. This is an additional reason
why Justice Shali cannot hear WP Civil 1280 of 2012.

Justice Shali's wife works as an officer in an Indian Navratna PSU.
Does she work in BHEL? And does she have dealings with BHEL officers
who might be implicated in the corruption complaints which are the
subject matter of WP Civil 1280 of 2012?

I sought recusal by Justice Shali for the aforementioned reasons.

On 29 April 2014, I asked Justice Shali at 2:30 when the Special
Division Bench would sit. His reply was shocking. He told me it would
sit at 4:30. Court rises at 4:30. What hearing would this Bench have
provided if it convened at 4:30 pm? This is exactly the tactic used
earlier by the Division Bench of Judges S K Misra and Suresh Kait to
prevent hearing of WP Civil 1280 of 2012 on more than one occasion. I
point out that judges are obligated to handle their board in a manner
so that the Special Division Bench matter listed before them can be
heard and there is sufficient time allocated to the matter.

Finally the Division Bench of Justice Shali and Justice G P Mittal
convened at 4:50 pm on 29 April 2014 after Justice Shali rose from his
single bench at 4:20. Justice Shali recused on my request and the
Division Bench of Justice Shali and Justice G P Mittal have directed
that WP Civil 1280 of 2012 be listed before a different bench on 6 May
2014. However I point out that despite my telling them that I was
being poisoned, Justice Shali and Justice G P Mittal refused to list
this matter the next day or the day after and were first insistent on
listing it after 10 days on 8 May 2014, which date was then changed to
6 May 2014. By adjourning this matter for a week, Justice Shali and
Justice G P Mittal have both facilitated my further poisoning and
targeting during this interegnum.

Also, Justice Shali and Justice G P Mittal were first also insistent
that they would adjourn the matter and list it on a Friday. This
matter cannot be heard on a Friday (due to lack of time on a Friday)
and this fact was accepted by Justice Nandrajog, who earlier acting in
the capacity of the Acting Chief Justice had posted this matter on a
tuesday in March 2014 after noting that it would never get heard on a
friday. Justice Shali and Justice G P Mittal's attempt to post this
matter on a Friday again establishes the intent of these judges to
prevent this matter from being heard.

I am therefore writing to you to bring to your attention that the only
judges of the Delhi High Court who are not disqualified from hearing
WP Civil 1280 of 2012 and the two connected matters (OMP 647 of 2012
and Criminal Contempt Case 3 of 2012) are Justice Gorla Rohini and
Justice G P Mittal. I may add that I also have concerns about Justice
G P Mittal now because of what I have narrated above about the hearing
on 29 April 2014.

I again repeat my request that these matters be brought to the
attention of the Chief Justice of India with a request that the Chief
Justice of India transfer these matters to the Supreme Court of India
for hearing. I repeat and reiterate the contents of my letter
addressed to the Chief Justice of the Delhi High Court dated 10
January 2014.
