Your communication dated 2 June 2016 is factually incorrect. My membership of the India Habitat Centre was never marked inactive and/ or I was never informed of this, nor did I receive any such notice.
The correct facts are as follows. I am a lawyer who ended up as a whistle-blower and made grave and evidence backed corruption complaints against General Electric Company, officials of the Ministry of Railways and then Deputy Chairman of the Planning Commission, Mr Montek Singh Ahluwalia.
I had filed a writ petition in the Delhi High Court in this connection, being Writ Petition Civil No. 1280/ 2012. I was being targeted and harassed and several orders were passed in that matter directing the Police and other authorities to protect me, which were never complied with.
In 2012-2013, I was a regular user of the IHC library, and I was targeted there using some other members and visitors who started visiting the library at the same time as me and with the express purpose of targeting me. Some of your library and maintenance staff and security guards were also used against me.
The intent was to drive me away from the library. I made several written complaints about this to the IHC which were never responded to or addressed.
On 15 March 2013, when I was in the IHC library, one Mr Pankaj Srivastava handed me a letter which purported to suspend my membership with immediate effect and I was peremptorily told to leave the library. I did.
After this, I exchanged correspondence about this with the IHC which along with some other relevant correspondence is reproduced below. Unfortunately, I lost the hard copy of the letter dated 15 March 2013 that Pankaj Srivastava handed over to me. It should however be in your records. Please provide a duplicate copy to me for my record.
I heard nothing further from the IHC. I intended to file a writ petition against the IHC challenging this illegal suspension of my membership without any notice or opportunity of hearing. However, I was busy with my case against GE and busy fighting for my life.
At present, I am before the Supreme Court of India in a connected matter.
So it is incorrect for your letter to state that my membership was marked inactive. Instead it was illegally suspended without notice to me and without affording me an opportunity to respond and my written requests to withdraw such "suspension" were ignored.
I certainly did not receive any notice from the IHC informing me that my membership had been marked inactive.
In view of these facts, I request that you do not remove my name from the IHC membership rolls.
I am not at fault here for non-payment of any annual membership dues or for my membership being allegedly treated as inactive.
On the contrary, I was the victim of an illegal, uncalled for and unauthorised suspension of my membership by Mr Raj Liberhan at the behest of powerful persons like Montek Singh Ahluwalia who wanted to prevent me from using the IHC library.
Please reactivate my membership and let me know what dues are outstanding, so that I can clear these.
Also, I request that you send any correspondence to me by email at my email addresses seema.sapra@gmail.com and seemasapra@hotmail.com. My address in your records is no longer valid. Unfortunately, at the present time, I do not have a permanent fixed address.
I hope I will not have to resort to court proceedings by way of a writ petition against the IHC in the Supreme Court of India to retain and avail of my IHC membership rights.

Attached is an application I have filed today in the Delhi High Court in W.P. (C ) 1280 of 2012. The prayers are that the court:
(a) Take on record the amended memo of parties (as set out in Annexure P-2 herein), replacing Siemens Aktiengesellschaft (incorporated in Germany, and having its office at Wittelbacherplatz 2, 80333 Munich, Germany) as respondent 13 in place of Siemens India;
(b) Issue notice in W. P. (C ) 1280 of 2012 to Siemens Aktiengesellschaft (incorporated in Germany, and having its office at Wittelbacherplatz 2, 80333 Munich, Germany);
(c) Permit the petitioner to serve Siemens Aktiengesellschaft by email on the lines of this court's earlier order dated December 21, 2012 and also by dasti email sent by the petitioner to Siemens Aktiengesellschaft from the petitioner's own email address;
(d) Pass such other and further orders as this Hon'ble Court may deem fit and proper.
Also, a few minutes ago, "Mr Pankaj Srivastava" came up to me in the IHC library and handed me a letter signed by "Mr Raj Liberhan." The Director of the India Habitat Center is Raj Librehan and not Raj Liberhan. So this letter has been issued under the wrong name.
This alleged letter tells me that the India Habitat Center is suspending my privileges to the use of the India Habitat Center with immediate effect.
The reason given is entirely false complaints that I am "stalking" library members and have been "loitering" in the staircase of the Convention Center. I will answer all any and all of these complaints.
These complaints and statements are all false. I am so cautious that I even refrain from interacting with the other persons frequenting the library.
And in any case, the India Habitat Center cannot take such drastic action against me without even hearing me or giving me an opportunity to reply to these so-called complaints against me.
If the India Habitat Center or Mr Raj Librehan has any complaints against me or has received any complaints against me, please provide me with copies and with details of these complaints and who has made them so that I can reply to those complaints and point out how utterly false, baseless and malicious they are.
I request that the India Habitat Center refrain from taking any unlawful action against its rules and without giving me an opportunity of responding.

Mr Raj Liberhan, I believe that the IHC rules set out in its Memorandum of Association do not provide for such immediate suspension of member benefits without notice and without hearing. Complaints if any are to be heard by the entire governing council. The Director of the IHC alone has no power to suspend a member's privileges or without prior notice or hearing. I have done nothing wrong that can give rise to any cause for suspension of my member privileges. The last paragraph of your letter states: "We have no option but to suspend your privileges to the use of the HLRC, the Library Lounge, and other IHC Members' areas with immediate effect. We have to instruct our security not to allow you into our premises till we receive an unqualified assurance of proper conduct and adherence to IHC rules". Mr Raj Liberhan, I believe that the IHC rules set out in its Memorandum of Association do not provide for such immediate suspension of member benefits without notice and without hearing. Complaints if any are to be heard by the entire governing council. The Director of the IHC alone has no power to suspend a member's privileges or without prior notice or hearing. I have done nothing wrong that can give rise to any cause for suspension of my member privileges. All and Mr Raj Liberhan,
I just looked up the India Habitat Center's director's name on the website. It might be Raj Librehan or Raj Liberhan.
But in any case, my member privileges at the India Habitat Center cannot be suspended like this by simply handing me a letter and asking me to leave the premises.
I have not stalked anyone. In fact, I have concrete evidence that some persons visiting the library regularly were/ are being used to target me because of my whistleblower corruption case against General Electric and Mr Montek Singh Ahluwalia. I can provide these complaints and this evidence to the India Habitat Center.
I have not loitered in the staircase as alleged.
I am surprised that this is the first I am hearing about any such allegations of loitering.
Why was I not told about such alleged loitering earlier. The normal course would be to first request a member not to loiter or to inform a member of access timings etc.
I have evidence that some IHC staff and Old World Hospitality staff and security guards have been used to target me. I can provide this evidence and these complaints to the India Habitat Center.
IHC rules do not allow such unilateral suspension of my privileges for cooked up reasons and without giving me an opportunity of responding and presenting my case.
Please provide me with a copy of these alleged complaints against me. Please provide me with a copy of the IHC membership rules. Please provide me with an opportunity of responding to these complaints.
In case the India Habitat Center takes such unlawful and precipitate action against me against all due process and without hearing me and against rules and all norms of natural justice, I will be constrained to approach the court for redress. The India Habitat Center is a State funded institution.
The manner in which this alleged notice was sought to be served upon me and this extreme step of suspending my privileges with immediate effect and asking me to leave the premises without giving me any prior information, hearing, or even warning points in the direction of this action being motivated and malafide and as being part of the campaign against me because of my corruption and whistleblower petition against General Electric and Mr Montek Singh Ahluwalia.
Mr Raj Liberhan, You have an unqualified assurance of proper conduct and adhereance to rules from my side. I repeat and reiterate this assurance.
However, I would like copies of these alleged complaints against me and I would like to respond to them in detail.

Ms. Sapra, Reference both your mails. To remind you that the Director is the CEO and represents the Governing Council policies on everyday basis. Hence fully empowered under the rules to issue the letter of suspension. Your conduct has been under our observation and the barrage of mails on a daily basis including those copied to us on completely unrelated issues to IHC are on record. Your daily encounters and complaints against HLRC and guards etc which are baseless and without any foundation and preventing normal functioning of IHC's facilities. Your assurance in the above referred to mail is insincere and the very fact that it is copied to many unconnected people is yet another example of your attitude. Iam afraid that we have to continue the suspension and if we do not get a satisfactory evidence of your intention to abide by the rules, we will have no other option but to cancel your membership permanently. Dear Mr Raj Liberhan,
This is further to the letter handed over to me by Mr Pankaj Srivastava in the India Habitat Center library on 15 March 2013 and to your email sent to my hotmail account on 16 March 2013.
The letter I was given by Mr Pankaj Srivastava gave the following reasons for suspension of my membership benefits:
My complaints that library staff and security guards on IHC premises were being used to harass and target me. That I was "loitering" in the staircase in the India Habitat Center. That I was coming into the Convention Center building early in the morning That complaints of "stalking" had been received against me from some other member/s using the library
I replied to this letter by emails and pointed out the following:
These allegations were false I had not been provided with any such complaints against me and was not given any opportunity to respond. I requested for a copy of these complaints so that I could respond to them. I assured you that I was abiding by all IHC rules and fully intended to continue doing so. That the IHC rules provided for a procedure to address complaints and the power to curtail members' rights only lay with the Governing Council of the IHC. I pointed out that the suspension of my membership rights was malafide, motivated, illegal and amounted to retaliation against me as a whistleblower under the influence of the powerful interests opposing me because of my whistleblower writ petition.
Instead of providing me with the details of these complaints and an opportunity of responding, you by email dated 16 March 2013 stated:
That as Director of IHC, you were empowered under the rules to issue the letter of suspension. That my conduct has been under your "observation". That" the barrage of mails on a daily basis including those copied" to you "on completely unrelated issues to IHC are on record." That my "daily encounters and complaints against HLRC and guards etc" are baseless and without any foundation and preventing normal functioning of IHC's facilities." That my "assurance in the above referred to mail is insincere and the very fact that it is copied to many unconnected people is yet another example of your attitude." That you will "continue the suspension" and if you "do not get a satisfactory evidence of your intention to abide by the rules" you "will have no other option but to cancel your membership permanently." That you "regret" that my "assurance cannot be accepted unless it is totally unqualified and addressed only to IHC. Raj Liberhan"

Under law, you are first required to provide me with details of any alleged complaints against me and to provide me an opportunity to respond. You have failed to do this.
I have evidence (some of it already filed in court in my writ petition) that Habitat World staff and some IHC staff and contract security guards on the premises of the IHC have been used to target me. I am ready to discuss this evidence with you or the Governing Council in detail.
I also have evidence that falsifies the police affidavit filed in my writ petition that the Lodhi Road police station had contacted IHC security in connection with the court directions dated 25 May 2012 to the Police Commissioner and all other authorities to protect me and ensure that I, a "whistleblower", am not harmed. I have evidence that your security personnel, including security officers employed by Habitat World, Securitas and Eagle Hunter (the two security companies providing services at the IHC) were all unaware of any such court order or communication from the Lodhi Road police station.
One of my complaints has been that while my lungs were being poisoned, the air-conditioning blasts/ temperature in the library in areas where I was sitting were being turned on to make it extremely cold, as part of the conspiracy to poison my lungs and make me fall ill. Someone with lung inflammation on account of chemical exposure is likely to contract pneumonia in extremely cold conditions. (I have independent evidence of other library members complaining of the extreme cold in the library). In February, 2013, the door to the server room in the library was kept open and there was on occasion an acrid smell emanating from this room. Several users of the library were coughing as a result.
None of my complaints about harassment was ever dealt with by IHC as is evident from the fact that I did not at any point receive a reply from the IHC.
As far as the issue of my entering the Convention Center building early in the morning is concerned, I point out that for about 7-8 days in the beginning of March 2013, I did come to the IHC around 7-8 am, and finding the Convention Center building open, I walked in (in full view of your staff and security guards) and used the toilet and then left. I was never told that I could not use the toilets which were open. However, it seems that your security guards and in particular someone called Divakar, working with Habitat World received instructions to prevent me from using the toilets. These persons had the toilets locked up on 2-3 occasions and upon my polite request to staff, the toilets were opened. On the last occasion, finding the toilets locked, I instead used the toilet near the All American Diner where I also had breakfast.
So I was not loitering in your premises. The building was open and needing to use the toilet I went in, did so, and then left.
I have never otherwise "loitered" on IHC premises including in the staircase. The first night, towards the end of February, 2013, when I had no place to stay, I was sitting in the Convention Center lobby trying to decide my course of action. It did get late that day, but I was seated in full view of your staff. I was told by a staff member that they were closing the building and I said I was leaving and left. That night, I did use the lift to go up to the library floor, because I wanted to look at the notices. The library was closed and a Securitas security guard saw me outside the library. This can be no reason to suspend my membership rights.
On all other occasions, I have left the IHC around 8-9 pm and come in only around 9-10 am. Your CCTV recordings will confirm the above. I also have independent evidence of the above.
As far as the ridiculous statement about complaints received that I was "stalking" any library member, please send them to me so that I can expose these as malicious and motivated with intent to provide the IHC with a false excuse to prevent me from using the library and other member areas. I have already forwarded you the response that I have sent to Ms Akanksha Narain on her malicious email to me, which on the face of it shows the intent of Ms Akanksha Narain and Ms Poonam Dabas (her mother) to victimise me.
As far as the issue of my emails to the IHC is concerned, I do not see how this can be a ground to suspend my membership rights. I have been sending these emails to the IHC as a protective measure, which I have a right to do.
In your email dated 16 March 2013, you state that you have had my conduct under observation. Can I ask why you were observing my conduct without communicating any complaint against me? This statement establishes that the intent has been to victimise me and to prevent me from using the IHC facilities under the influence of the powerful interests opposing me. Before placing someone under observation, you would normally first approach that person.
I reiterate that under IHC rules, you as Director are not empowered to issue any letter of suspension. Complaints against IHC members can only be dealt with by the IHC Governing Council. Under the IHC rules, such action can also not be taken without notice to a member and without first providing such member with an opportunity to respond to any alleged complaints.
You also state that my "daily encounters and complaints against HLRC and guards etc" are baseless and without any foundation and preventing normal functioning of IHC's facilities." This is false on several counts. I have not had "daily encounters" with HLRC staff and guards. In fact, I have ignored several valid reasons for complaint and have mostly avoided interacting with security guards. I even started carrying an extra warm jacket to the library so as to take my own protective measures against attempts to make me fall ill by turning the AC on full blast.
How can my written complaints sent to you on email prevent the normal functioning of IHC facilities? What action have you taken on these complaints and on what grounds do you call them baseless and without foundation? These complaints are genuine and backed with evidence. Given the way these complaints have been ignored, it is likely that IHC staff have also been involved in the harassment.
I am astonished at your completely unsubstantiated statement that my assurance that I will comply with all IHC rules is "insincere". You asked me for such an assurance and I provided it and stated that I had always adhered to IHC rules and would continue to do so. How is this assurance insincere?
As this completely unlawful action of unilateral suspension of my IHC membership rights is part of the victimisation on account of my complaints against General Electric and Mr Montek Singh Ahluwalia (filed in court), I thought it appropriate to convey the communication on this issue to other authorities including the Delhi High Court, This does not make my assurance insincere or conditional.
It appears as if you expected me to submit to and accept your false complaints and allegations against me and to "plead" for restoration of my rightful entitlement to all membership rights. I am not appearing before a school principal who can object to my "attitude". I am an IHC member who has paid membership dues and who under IHC rules is entitled to my membership rights. These rights cannot be taken away arbitrarily on cooked up and false grounds without any notice to me.
My attitude is to stand up in defence of my rights and against victimisation. Why does this "attitude" bother you? The issue in any event is not my attitude. My membership rights can only be curtailed for valid grounds and not because the IHC Director might not like my attitude.
On the other hand, the attitude of IHC management to the issue of a whistleblower complaining of genuine harassment leaves much to be desired.
Your statements, that my "assurance in the above referred to mail is insincere and the very fact that it is copied to many unconnected people is yet another example of your (my) attitude"; that you will "continue the suspension" and if you "do not get a satisfactory evidence of your (my) intention to abide by the rules" you "will have no other option but to cancel your (my) membership permanently"; and that you "regret" that my "assurance cannot be accepted unless it is totally unqualified and addressed only to IHC. Raj Liberhan"; are, if I may say so with the utmost respect, reminiscent of a dictator who acts arbitrarily knowing that the balance of power is in his favour.
You also state that you will "continue the suspension" and if you "do not get a satisfactory evidence of your (my) intention to abide by the rules" you "will have no other option but to cancel your (my) membership permanently."
I have already unconditionally and unambiguously communicated my intention to abide by all IHC rules. I have always abided by these rules. (I point out that you have failed to point out which, if any, IHC rule I have violated.) I repeat this assurance of my commitment to IHC rules. What other kind of assurance do you want? Please let me know so that I can provide that also.
Meanwhile can IHC management comply with IHC rules and provide me with the details (and copies) of the alleged complaints against me so that I can respond to these appropriately?
You also state that you "regret" that my "assurance cannot be accepted unless it is totally unqualified and addressed only to IHC, Raj Liberhan". My assurance is totally unqualified. It is addressed to you. It is necessary for this communication to be brought to the attention of appropriate authorities. You cannot insist on secrecy in communications on this issue.
I again call upon you to stop your unlawful curtailment of my membership rights and to not obstruct my use of IHC member facilities. I am taking this unlawful curtailment of my membership rights very seriously and will if necessary, institute appropriate legal proceedings to protect my rights.
Lastly, I have received communications from the library reminding me to return a book which is due. Please let me know how to return this book as you have instructed your security not to permit me to enter the library.

This is further to the letter handed over to me by Mr Pankaj Srivastava in the India Habitat Center library on 15 March 2013 and to your email sent to my hotmail account on 16 March 2013.
The letter I was given by Mr Pankaj Srivastava gave the following reasons for suspension of my membership benefits:
My complaints that library staff and security guards on IHC premises were being used to harass and target me. That I was "loitering" in the staircase in the India Habitat Center. That I was coming into the Convention Center building early in the morning That complaints of "stalking" had been received against me from some other member/s using the library
I replied to this letter by emails and pointed out the following:
These allegations were false I had not been provided with any such complaints against me and was not given any opportunity to respond. I requested for a copy of these complaints so that I could respond to them. I assured you that I was abiding by all IHC rules and fully intended to continue doing so. That the IHC rules provided for a procedure to address complaints and the power to curtail members' rights only lay with the Governing Council of the IHC. I pointed out that the suspension of my membership rights was malafide, motivated, illegal and amounted to retaliation against me as a whistleblower under the influence of the powerful interests opposing me because of my whistleblower writ petition.
Instead of providing me with the details of these complaints and an opportunity of responding, you by email dated 16 March 2013 stated:
That as Director of IHC, you were empowered under the rules to issue the letter of suspension. That my conduct has been under your "observation". That" the barrage of mails on a daily basis including those copied" to you "on completely unrelated issues to IHC are on record." That my "daily encounters and complaints against HLRC and guards etc" are baseless and without any foundation and preventing normal functioning of IHC's facilities." That my "assurance in the above referred to mail is insincere and the very fact that it is copied to many unconnected people is yet another example of your attitude." That you will "continue the suspension" and if you "do not get a satisfactory evidence of your intention to abide by the rules" you "will have no other option but to cancel your membership permanently." That you "regret" that my "assurance cannot be accepted unless it is totally unqualified and addressed only to IHC. Raj Liberhan"
Let me point out the following as a preliminary response to your communications:
Under law, you are first required to provide me with details of any alleged complaints against me and to provide me an opportunity to respond. You have failed to do this.
I have evidence (some of it already filed in court in my writ petition) that Habitat World staff and some IHC staff and contract security guards on the premises of the IHC have been used to target me. I am ready to discuss this evidence with you or the Governing Council in detail.
I also have evidence that falsifies the police affidavit filed in my writ petition that the Lodhi Road police station had contacted IHC security in connection with the court directions dated 25 May 2012 to the Police Commissioner and all other authorities to protect me and ensure that I, a "whistleblower", am not harmed. I have evidence that your security personnel, including security officers employed by Habitat World, Securitas and Eagle Hunter (the two security companies providing services at the IHC) were all unaware of any such court order or communication from the Lodhi Road police station.
One of my complaints has been that while my lungs were being poisoned, the air-conditioning blasts/ temperature in the library in areas where I was sitting were being turned on to make it extremely cold, as part of the conspiracy to poison my lungs and make me fall ill. Someone with lung inflammation on account of chemical exposure is likely to contract pneumonia in extremely cold conditions. (I have independent evidence of other library members complaining of the extreme cold in the library). In February, 2013, the door to the server room in the library was kept open and there was on occasion an acrid smell emanating from this room. Several users of the library were coughing as a result.
None of my complaints about harassment was ever dealt with by IHC as is evident from the fact that I did not at any point receive a reply from the IHC.
As far as the issue of my entering the Convention Center building early in the morning is concerned, I point out that for about 7-8 days in the beginning of March 2013, I did come to the IHC around 7-8 am, and finding the Convention Center building open, I walked in (in full view of your staff and security guards) and used the toilet and then left. I was never told that I could not use the toilets which were open. However, it seems that your security guards and in particular someone called Divakar, working with Habitat World received instructions to prevent me from using the toilets. These persons had the toilets locked up on 2-3 occasions and upon my polite request to staff, the toilets were opened. On the last occasion, finding the toilets locked, I instead used the toilet near the All American Diner where I also had breakfast.
So I was not loitering in your premises. The building was open and needing to use the toilet I went in, did so, and then left.
I have never otherwise "loitered" on IHC premises including in the staircase. The first night, towards the end of February, 2013, when I had no place to stay, I was sitting in the Convention Center lobby trying to decide my course of action. It did get late that day, but I was seated in full view of your staff. I was told by a staff member that they were closing the building and I said I was leaving and left. That night, I did use the lift to go up to the library floor, because I wanted to look at the notices. The library was closed and a Securitas security guard saw me outside the library. This can be no reason to suspend my membership rights.
On all other occasions, I have left the IHC around 8-9 pm and come in only around 9-10 am. Your CCTV recordings will confirm the above. I also have independent evidence of the above.
As far as the ridiculous statement about complaints received that I was "stalking" any library member, please send them to me so that I can expose these as malicious and motivated with intent to provide the IHC with a false excuse to prevent me from using the library and other member areas. I have already forwarded you the response that I have sent to Ms Akanksha Narain on her malicious email to me, which on the face of it shows the intent of Ms Akanksha Narain and Ms Poonam Dabas (her mother) to victimise me.
As far as the issue of my emails to the IHC is concerned, I do not see how this can be a ground to suspend my membership rights. I have been sending these emails to the IHC as a protective measure, which I have a right to do.
In your email dated 16 March 2013, you state that you have had my conduct under observation. Can I ask why you were observing my conduct without communicating any complaint against me? This statement establishes that the intent has been to victimise me and to prevent me from using the IHC facilities under the influence of the powerful interests opposing me. Before placing someone under observation, you would normally first approach that person.
I reiterate that under IHC rules, you as Director are not empowered to issue any letter of suspension. Complaints against IHC members can only be dealt with by the IHC Governing Council. Under the IHC rules, such action can also not be taken without notice to a member and without first providing such member with an opportunity to respond to any alleged complaints.
You also state that my "daily encounters and complaints against HLRC and guards etc" are baseless and without any foundation and preventing normal functioning of IHC's facilities." This is false on several counts. I have not had "daily encounters" with HLRC staff and guards. In fact, I have ignored several valid reasons for complaint and have mostly avoided interacting with security guards. I even started carrying an extra warm jacket to the library so as to take my own protective measures against attempts to make me fall ill by turning the AC on full blast.
How can my written complaints sent to you on email prevent the normal functioning of IHC facilities? What action have you taken on these complaints and on what grounds do you call them baseless and without foundation? These complaints are genuine and backed with evidence. Given the way these complaints have been ignored, it is likely that IHC staff have also been involved in the harassment.
I am astonished at your completely unsubstantiated statement that my assurance that I will comply with all IHC rules is "insincere". You asked me for such an assurance and I provided it and stated that I had always adhered to IHC rules and would continue to do so. How is this assurance insincere?
As this completely unlawful action of unilateral suspension of my IHC membership rights is part of the victimisation on account of my complaints against General Electric and Mr Montek Singh Ahluwalia (filed in court), I thought it appropriate to convey the communication on this issue to other authorities including the Delhi High Court, This does not make my assurance insincere or conditional.
It appears as if you expected me to submit to and accept your false complaints and allegations against me and to "plead" for restoration of my rightful entitlement to all membership rights. I am not appearing before a school principal who can object to my "attitude". I am an IHC member who has paid membership dues and who under IHC rules is entitled to my membership rights. These rights cannot be taken away arbitrarily on cooked up and false grounds without any notice to me.
My attitude is to stand up in defence of my rights and against victimisation. Why does this "attitude" bother you? The issue in any event is not my attitude. My membership rights can only be curtailed for valid grounds and not because the IHC Director might not like my attitude.
On the other hand, the attitude of IHC management to the issue of a whistleblower complaining of genuine harassment leaves much to be desired.
Your statements, that my "assurance in the above referred to mail is insincere and the very fact that it is copied to many unconnected people is yet another example of your (my) attitude"; that you will "continue the suspension" and if you "do not get a satisfactory evidence of your (my) intention to abide by the rules" you "will have no other option but to cancel your (my) membership permanently"; and that you "regret" that my "assurance cannot be accepted unless it is totally unqualified and addressed only to IHC. Raj Liberhan"; are, if I may say so with the utmost respect, reminiscent of a dictator who acts arbitrarily knowing that the balance of power is in his favour.
You also state that you will "continue the suspension" and if you "do not get a satisfactory evidence of your (my) intention to abide by the rules" you "will have no other option but to cancel your (my) membership permanently."
I have already unconditionally and unambiguously communicated my intention to abide by all IHC rules. I have always abided by these rules. (I point out that you have failed to point out which, if any, IHC rule I have violated.) I repeat this assurance of my commitment to IHC rules. What other kind of assurance do you want? Please let me know so that I can provide that also.
Meanwhile can IHC management comply with IHC rules and provide me with the details (and copies) of the alleged complaints against me so that I can respond to these appropriately?
You also state that you "regret" that my "assurance cannot be accepted unless it is totally unqualified and addressed only to IHC, Raj Liberhan". My assurance is totally unqualified. It is addressed to you. It is necessary for this communication to be brought to the attention of appropriate authorities. You cannot insist on secrecy in communications on this issue.
I again call upon you to stop your unlawful curtailment of my membership rights and to not obstruct my use of IHC member facilities. I am taking this unlawful curtailment of my membership rights very seriously and will if necessary, institute appropriate legal proceedings to protect my rights.
Lastly, I have received communications from the library reminding me to return a book which is due. Please let me know how to return this book as you have instructed your security not to permit me to enter the library.
I look forward to your response.

I again spent last night in my car as I have been rendered homeless. This is now thirty nine nights in a row that I have been forced to spend in my car because Justice Gita Mittal and Justice J R Midha (of the Delhi High Court) have not found time to hear my applications for protection and safe housing. Both these judges know that I am being compelled to spend the night in my car.
Last night (night of 5 and 6 April 2013), I had parked my car close to B 66 in Defence Colony around 10 pm.
From that time until about midnight, the security guards from B 66 and the house behind it and a man who identified himself as a cook employed in B 66 repeatedly harassed me by deliberately inciting 3-4 stray dogs outside the house to bark. Just before midnight, these guards were inciting dogs to attack a calf which appeared on the spot or was let loose. I got out of the car and photographed the scene. At this the guard got aggressive and the alleged cook emerged from the house and started apologizing to me. I recorded their statements.
The security guards were from a security firm called Colonel Security.
I then decided to move my car to another spot.
On the way, I spotted the two policemen who have been circling my car at night and inciting these incidents of harassment. The licence plate number was DL 1S N 9518..
I also noticed a private security guard on a bicycle circling my car at night and blowing a whistle while passing my car.

This is in response to your email sent to me on 11 March 2013 (reproduced below) to my hotmail account. As your email is deliberately false and misleading, let me set the facts straight first.
I am a lawyer who has filed a whistleblower corruption petition against General Electric, Mr Montek Singh Ahluwalia, and the Railway Ministry which is being heard by the Delhi High Court (Seema Sapra v. General Electric Company and Others, Writ Petition (Civil) No. 1280/ 2012). I have complained of a threat to my life and of planned harassment and victimization.
I am an India Habitat Center member and have been using the library frequently since June 2012. I frequented the Habitat Center library as a safe haven where I could spend time and work.
I have evidence that Habitat Center staff and security guards were being used to target me. I also noticed that some library users whose visits to the library frequently coincided with mine, have also instigated and / or participated in such harassment. Among these persons who have been used to target me in the IHC library are you and Ms Poonam Dabas, who I gathered is your mother or relative. The other persons who have targeted me in the library include Captain Sarabjit Butalia and Dr U V Singh.
Several persons regularly visiting the library w3hen I was using it daily are persons who have no history of library usage earlier and who are connected in some way to lawyers through ongoing court cases. These persons include the family members of one Mr Sumit Khaneja who is entangled in acrimonious litigation in the Delhi High Court.
Thee different lawyers were also frequenting the library when I was using it. It is very unusual for lawyers to spend such long hours in the IHC library. My case is an exception because I was using the library as a safe place..
Let me now come to the reason that I sent you the email that you have objected to. A few days before I sent this email, I was being poisoned by the deliberate introduction of toxic chemicals and fumes into my accommodation. As a result, I had severe inflammation and was coughing severely.
The day after I complained to the authorities of a particularly severe incident of such poisoning, Ms Poonam Dabas who I did not know and had never really spoken to before, came up to me in the library uninvited and showed me a plastic bottle and stated that my throat was very sensitive and that I needed to take this medicine. I informed her that the coughing was on account of poisoning and that I was a lawyer who had filed a whistleblower corruption petition,. I offered to show her the court papers and did in fact show her the court orders online. At that time, Ms Poonam Dabas pretended to be concerned but stated that journalists were often persuaded by powerful interests through threats etc not to publish such news.
My only interaction with Ms Poonam Dabas before this was once when she for no reason "accused" me of using the computer the whole day. This was when Ms Poonam Dabas herself was occupying two carrels simultaneously and a computer. I did not respond to Ms Poonam Dabas at that time.
After the poisoning in January and February 2013, I developed a cough. At this time, you, Ms Poonam Dabas, another young lady whose family also has an ongoing court litigation and a young man (Shantanu Yadav) started seating yourselves around me in the library. I noticed that you as a group were making fun of my coughing. If I coughed, one of you immediately imitated it. I was recording my coughing as evidence, so I happen to have evidence of these incidents.
As you will no doubt recall, one evening, you were standing behind me speaking to Shantanu Yadav. I coughed and you imitated it. You were also talking very loudly. I requested you to speak softly. At this, you very rudely told me that my coughing had also been disturbing you. I objected to your statement and replied that I could not control my coughing and it was not deliberate and that your mother, Ms Poonam Dabas knew why I was coughing. At this your mother Poonam Dabas also jumped in and started attacking me. She told me that I should stay at home if I was coughing. She stated that there were "complaints against me galore". She told one of the Securitas's guards Sanjiv Kumar, very loudly across the library that I had some disease ("pata nahin kya bimari hai".).
I ignored all of you and after this I ensured that I did not sit close to anyone of you. In fact, on most subsequent library visits, I sat in a separate section of the library.
One one occasion subsequently, I asked Shantanu Yadav not to participate in such harassment and requested his email so that I could tell him why I was being harassed. Mr Shantanu Yadav did not share his email and I left it at that.
At around this time, I also emailed management of Securitas and informed them of how Securitas security guards were being used to harass me. I am absolutely certain that Captain Sarabjit Butalia has been involved in this harassment.
It was after these heightened incidents of harassment that I decided to put you, your mother (Poonam Dabas), Sarabjit Butalia, and Dr U V Singh on notice about this harassment.
(I point out that your mother was involved in a legal case which has presumably been settled recently. A settlement of this nature would involve payment of compensation to your mother, who has therefore recently benefited monetarily. Dr U V Singh (it appears) is facing criminal prosecution of some nature)
I searched for your mother's email but could not locate it online. I did find yours, Captain Sarabjit Butalia's and Dr U V Singh's emails. I simply forwarded you the email below.
This is the only contact I have had with you and is the sole reason for my interest in locating your email and in sending you this email.
Knowing fully well, that you and your mother were deliberately participating in harassing me in the library (no doubt for some benefits and quid pro quo), you have sent a false email mis-recording the facts and have tried to smear me as having "stalked" you. This is a ridiculous accusation. (You recently seem to have secured a UN job. I wonder if someone helped you get this job as repayment for participating in harassing me.)
I am completely within my legal rights in responding to harassment and in identifying persons participating in such harassment and in contacting them via email putting them on notice. This is all that I did.
I have no interest in you and have no desire to interact with you or to correspond with you by email or otherwise. But I will not tolerate victimization silently. You and your mother participated in targeting me in the India Habitat Center library and I will ensure that you are held accountable for this.
I will be taking further legal action in response to your false and malicious complaint against me which only constitutes further evidence of you being used to harass and target me.
Let me point out that Ms Poonam Dabas who is a current/ former Doordarshan journalist (and therefore close to government circles), intentionally tried to misrepresent my coughing (on account of poisoning) and to offer me some "medicine". (How do I know what she was trying to get me to consume? This could have been an attempt to drug or poison me.) She then tried to spread the story that I had some unknown illness. This coming from a woman who was hostile to me and had no interest in my welfare, is clear evidence that she stated these things on instructions received from someone who had an interest in covering up my complaint and symptoms of poisoning and in eliminating me. This amounts to much more than harassment and constitutes participation in a criminal conspiracy to eliminate a witness to corruption.

There are two private security agencies operating in the India Habitat Center. The India Habitat Center itself uses Securitas. Old World Hospitality or Habitat World uses Eagle Hunter.
Securitas, which has 4 security guards posted in the library where these guards have colluded in targeting me has close ties to General Electric. Not only does Securitas provide its services to General Electric in several countries, but Securitas is also a client of General Electric. Securitas purchases security products, technologies etc from General Electric.
I attach several documents that show these ties between Securitas and General Electric.
It is very likely that GE India also uses Securitas for its facilities in India.
There is more evidence with me that Securitas' guards in India Habitat Center are targeting me, are spreading false and malicious rumpours about me, are recuiting other staff present at the India Habitat Center to target me and are also keeping a close surveillance on me. I would not be surprised if my computer usage at the Habitat library is also under surveillance.

Dear Mr Raj Liberhan,
This is further to the letter handed over to me by Mr Pankaj Srivastava in the India Habitat Center library on 15 March 2013 and to your email sent to my hotmail account on 16 March 2013.
The letter I was given by Mr Pankaj Srivastava gave the following reasons for suspension of my membership benefits:
My complaints that library staff and security guards on IHC premises were being used to harass and target me. That I was "loitering" in the staircase in the India Habitat Center. That I was coming into the Convention Center building early in the morning That complaints of "stalking" had been received against me from some other member/s using the library
I replied to this letter by emails and pointed out the following:
These allegations were false I had not been provided with any such complaints against me and was not given any opportunity to respond. I requested for a copy of these complaints so that I could respond to them. I assured you that I was abiding by all IHC rules and fully intended to continue doing so. That the IHC rules provided for a procedure to address complaints and the power to curtail members' rights only lay with the Governing Council of the IHC. I pointed out that the suspension of my membership rights was malafide, motivated, illegal and amounted to retaliation against me as a whistleblower under the influence of the powerful interests opposing me because of my whistleblower writ petition.
Instead of providing me with the details of these complaints and an opportunity of responding, you by email dated 16 March 2013 stated:
That as Director of IHC, you were empowered under the rules to issue the letter of suspension. That my conduct has been under your "observation". That" the barrage of mails on a daily basis including those copied" to you "on completely unrelated issues to IHC are on record." That my "daily encounters and complaints against HLRC and guards etc" are baseless and without any foundation and preventing normal functioning of IHC's facilities." That my "assurance in the above referred to mail is insincere and the very fact that it is copied to many unconnected people is yet another example of your attitude." That you will "continue the suspension" and if you "do not get a satisfactory evidence of your intention to abide by the rules" you "will have no other option but to cancel your membership permanently." That you "regret" that my "assurance cannot be accepted unless it is totally unqualified and addressed only to IHC. Raj Liberhan"
Let me point out the following as a preliminary response to your communications:
Under law, you are first required to provide me with details of any alleged complaints against me and to provide me an opportunity to respond. You have failed to do this.
I have evidence (some of it already filed in court in my writ petition) that Habitat World staff and some IHC staff and contract security guards on the premises of the IHC have been used to target me. I am ready to discuss this evidence with you or the Governing Council in detail.
I also have evidence that falsifies the police affidavit filed in my writ petition that the Lodhi Road police station had contacted IHC security in connection with the court directions dated 25 May 2012 to the Police Commissioner and all other authorities to protect me and ensure that I, a "whistleblower", am not harmed. I have evidence that your security personnel, including security officers employed by Habitat World, Securitas and Eagle Hunter (the two security companies providing services at the IHC) were all unaware of any such court order or communication from the Lodhi Road police station.
One of my complaints has been that while my lungs were being poisoned, the air-conditioning blasts/ temperature in the library in areas where I was sitting were being turned on to make it extremely cold, as part of the conspiracy to poison my lungs and make me fall ill. Someone with lung inflammation on account of chemical exposure is likely to contract pneumonia in extremely cold conditions. (I have independent evidence of other library members complaining of the extreme cold in the library). In February, 2013, the door to the server room in the library was kept open and there was on occasion an acrid smell emanating from this room. Several users of the library were coughing as a result.
None of my complaints about harassment was ever dealt with by IHC as is evident from the fact that I did not at any point receive a reply from the IHC.
As far as the issue of my entering the Convention Center building early in the morning is concerned, I point out that for about 7-8 days in the beginning of March 2013, I did come to the IHC around 7-8 am, and finding the Convention Center building open, I walked in (in full view of your staff and security guards) and used the toilet and then left. I was never told that I could not use the toilets which were open. However, it seems that your security guards and in particular someone called Divakar, working with Habitat World received instructions to prevent me from using the toilets. These persons had the toilets locked up on 2-3 occasions and upon my polite request to staff, the toilets were opened. On the last occasion, finding the toilets locked, I instead used the toilet near the All American Diner where I also had breakfast.
So I was not loitering in your premises. The building was open and needing to use the toilet I went in, did so, and then left.
I have never otherwise "loitered" on IHC premises including in the staircase. The first night, towards the end of February, 2013, when I had no place to stay, I was sitting in the Convention Center lobby trying to decide my course of action. It did get late that day, but I was seated in full view of your staff. I was told by a staff member that they were closing the building and I said I was leaving and left. That night, I did use the lift to go up to the library floor, because I wanted to look at the notices. The library was closed and a Securitas security guard saw me outside the library. This can be no reason to suspend my membership rights.
On all other occasions, I have left the IHC around 8-9 pm and come in only around 9-10 am. Your CCTV recordings will confirm the above. I also have independent evidence of the above.
As far as the ridiculous statement about complaints received that I was "stalking" any library member, please send them to me so that I can expose these as malicious and motivated with intent to provide the IHC with a false excuse to prevent me from using the library and other member areas. I have already forwarded you the response that I have sent to Ms Akanksha Narain on her malicious email to me, which on the face of it shows the intent of Ms Akanksha Narain and Ms Poonam Dabas (her mother) to victimise me.
As far as the issue of my emails to the IHC is concerned, I do not see how this can be a ground to suspend my membership rights. I have been sending these emails to the IHC as a protective measure, which I have a right to do.
In your email dated 16 March 2013, you state that you have had my conduct under observation. Can I ask why you were observing my conduct without communicating any complaint against me? This statement establishes that the intent has been to victimise me and to prevent me from using the IHC facilities under the influence of the powerful interests opposing me. Before placing someone under observation, you would normally first approach that person.
I reiterate that under IHC rules, you as Director are not empowered to issue any letter of suspension. Complaints against IHC members can only be dealt with by the IHC Governing Council. Under the IHC rules, such action can also not be taken without notice to a member and without first providing such member with an opportunity to respond to any alleged complaints.
You also state that my "daily encounters and complaints against HLRC and guards etc" are baseless and without any foundation and preventing normal functioning of IHC's facilities." This is false on several counts. I have not had "daily encounters" with HLRC staff and guards. In fact, I have ignored several valid reasons for complaint and have mostly avoided interacting with security guards. I even started carrying an extra warm jacket to the library so as to take my own protective measures against attempts to make me fall ill by turning the AC on full blast.
How can my written complaints sent to you on email prevent the normal functioning of IHC facilities? What action have you taken on these complaints and on what grounds do you call them baseless and without foundation? These complaints are genuine and backed with evidence. Given the way these complaints have been ignored, it is likely that IHC staff have also been involved in the harassment.
I am astonished at your completely unsubstantiated statement that my assurance that I will comply with all IHC rules is "insincere". You asked me for such an assurance and I provided it and stated that I had always adhered to IHC rules and would continue to do so. How is this assurance insincere?
As this completely unlawful action of unilateral suspension of my IHC membership rights is part of the victimisation on account of my complaints against General Electric and Mr Montek Singh Ahluwalia (filed in court), I thought it appropriate to convey the communication on this issue to other authorities including the Delhi High Court, This does not make my assurance insincere or conditional.
It appears as if you expected me to submit to and accept your false complaints and allegations against me and to "plead" for restoration of my rightful entitlement to all membership rights. I am not appearing before a school principal who can object to my "attitude". I am an IHC member who has paid membership dues and who under IHC rules is entitled to my membership rights. These rights cannot be taken away arbitrarily on cooked up and false grounds without any notice to me.
My attitude is to stand up in defence of my rights and against victimisation. Why does this "attitude" bother you? The issue in any event is not my attitude. My membership rights can only be curtailed for valid grounds and not because the IHC Director might not like my attitude.
On the other hand, the attitude of IHC management to the issue of a whistleblower complaining of genuine harassment leaves much to be desired.
Your statements, that my "assurance in the above referred to mail is insincere and the very fact that it is copied to many unconnected people is yet another example of your (my) attitude"; that you will "continue the suspension" and if you "do not get a satisfactory evidence of your (my) intention to abide by the rules" you "will have no other option but to cancel your (my) membership permanently"; and that you "regret" that my "assurance cannot be accepted unless it is totally unqualified and addressed only to IHC. Raj Liberhan"; are, if I may say so with the utmost respect, reminiscent of a dictator who acts arbitrarily knowing that the balance of power is in his favour.
You also state that you will "continue the suspension" and if you "do not get a satisfactory evidence of your (my) intention to abide by the rules" you "will have no other option but to cancel your (my) membership permanently."
I have already unconditionally and unambiguously communicated my intention to abide by all IHC rules. I have always abided by these rules. (I point out that you have failed to point out which, if any, IHC rule I have violated.) I repeat this assurance of my commitment to IHC rules. What other kind of assurance do you want? Please let me know so that I can provide that also.
Meanwhile can IHC management comply with IHC rules and provide me with the details (and copies) of the alleged complaints against me so that I can respond to these appropriately?

It is addressed to you. It is necessary for this communication to be brought to the attention of appropriate authorities. You cannot insist on secrecy in communications on this issue.
I again call upon you to stop your unlawful curtailment of my membership rights and to not obstruct my use of IHC member facilities. I am taking this unlawful curtailment of my membership rights very seriously and will if necessary, institute appropriate legal proceedings to protect my rights.
Lastly, I have received communications from the library reminding me to return a book which is due. Please let me know how to return this book as you have instructed your security not to permit me to enter the library.
