WP Civil 1280 of 2012 is listed today in the Delhi High Court before a
Division Bench of J. G S Sistani and J. A K Pathak.

This matter was listed on 8 May 2014 before J. G S Sistani and J. V K
Rao when J. V K Rao recused. I requested that the matter be posted
after a day or two because urgent orders were required as I am being
poisoned and targeted but J. Sistani insisted on adjourning the matter
for 7 days and it is now listed again today.

On 13 May 2014 (14 May being a court holiday) I went to the writ
branch to inquire who this matter has been assigned to. I was informed
that the file was still with the listing registrar.

When the cause list was published on the Delhi High Court website at
6:30 pm, this matter was not shown in the list. I called up the PA to
the Registrar General and at my intervention, I was later informed
that the matter had been marked to a Special Division Bench of J.
Sistani and J. A K Pathak. I was told that listing Registrar brought
this matter to the attention of Chief Justice Rohini only at around 6
pm on 13 May 2014. A supplementary cause list showing this matter was
published only on my intervention.

Today morning, the matter was not shown again in the causelist posted
outside Court 24 where J. Sistani is sitting. The supplementary list
with this matter was put up outside Court 24 only on my intervention.

At 10:30 am, I mentioned the matter before J. Sistani and asked him
when the special Division Bench would sit. He replied that he would
speak to J. A K Pathak during lunch time and the DB would sit after
lunch. I requested that he be mindful of my matter and allocate it
adequate time.

I would like to describe the hearing before J. Sistani and J. V K Rao
on 8 May 2014. I had in written communications to the Chief Justice
requested that this matter not be listed before J. Sistani or J. V K
Rao, despite that this matter was listed before them on 8 May 2014.

On 8 May 2014, the matter was taken up at 2:45 pm, when I requested J.
V K Rao to recuse because I have an application pending questioning J.
A K Sikri's role in the conspiracy and attempt to murder me on 17
February 2014. J. V K Rao has close ties to J. A K Sikri and was his
junior for a long time.

I was told by J. Sistani that J. V K Rao would not recuse and would
hear the matter. I replied that I had no faith that J. V K Rao could
hear the application against J. A K Sikri without bias.

J. Sistani's next statement to me was to ask what was the current
status of the tenders. I replied to this question, The next statement
from J. Sistani was to ask that had not the writ petition become
infructuous? I replied that it had not and wanted to read the prayers
in the writ petition. My laptop took some time to open the large pdf
file. As soon as I started to read the prayers, J. Sistani interrupted
me and asked me if I "really" wanted J. V K Rao to recuse. I said that
I did.

After this, the two judges conferred for a while. I was then asked by
J. Sistani about who was appearing for respondent 16. I replied that
Mr Vikram Dhokalia was appearing. I was then told by J. Sistani that
Mr Vikram Dhokalia did not appear before J. V K Rao and and that J. V
K Rao would therefore recuse.

I requested that the matter be placed on 12/ 13 May in that case but
J. Sistani insisted on adjourning the matter for 7 days to 15 May
2014.

I told J. G S Sistani that this was an urgent matter concering my need
for protection in light of the threat to my life. I requested the
Bench to read the order dated 22 April 2014 to appreciate the urgency
in the matter but J. Sistani outright refused to look at this order. I
requested a short date from J. Sistani and J. V K Rao and stated that
the Court often heard matters for ex parte injunctions in IP and
telecast rights matters the same day even, and this was a matter
involving a grave threat to a lawyers' life. To my complete
astonishment, J. Sistani denied that the matter was concerned with my
protection and he stated that there was no prayer for protection in
the writ petition.

I immediately contradicted this and had commenced reading the first
few words of prayer clause 4 in the writ petition which contains the
prayer for protection, when J. Sistani and J. V K Rao walked out of
court with me in mid-sentence.

I point out that between 8 and 15 May, 2014, I have been poisoned,
assaulted and robbed by a man when I was asleep in my car, and
targeted and harassed incessantly with police complicity.

I later asked Mr Vikram Dhokalia why he did not appear before J. V K
Rao. He replied it was because until 1994, both he and J. V K Rao had
worked in J. Sikri's chamber.

I point out that this matter has not become infructuous merely because
the Railway Ministry has cancelled the 2010 RFQs for the Marhowra and
Madhepura Projects. This cancellation was merely a ploy to cover up
the corruption complaints and an attempt to over-reach the Court.

I have made a corruption complaint against J. G S Sistani and an
ethics violation complaint against his son advocate Gurmehar S Sistani
which is on the court record in the captioned matter.

I will be seeking recusal by the Bench today and am waiting for the
Division Bench to assemble.
