Sabotage of today's court hearing, next hearing on 17 Dec 2014 - message from Seema Sapra, General Electric whistle-blower - WP Civil 1280 of 2012, a corruption whistle-blower petition in the Delhi High Court (Seema Sapra v General Electric Company and Others)

Today there was no court hearing in WP Civil 1290/ 2012, the corruption case filed by me against General Electric Company & Others as the Special Division Bench of J. Pratibha Rani and J. Jayant Nath did not assemble. The next date of hearing is 17 December 2014.


I describe below what transpired today. At around 12 pm, I asked J. Pratibha Rani in Court 26 when the Special Division Bench would sit. She first told me that the matter would not be heard today and her reasons were that she was unwell, she had to attend J. Sanjiv Sachdeva's mother's cremation etc. She wanted to adjourn the matter to January 2015. I insisted that the matter was urgent and needed to be heard. She then indicated that the Special Bench would convene at 2:30 pm.


Several judges attended the cremation of J. Sanjiv Sachdeva's mother at 12:30, but they all held court after lunch.


J. Pratibha Rani looked perfectly well and was well enough to hear all her single judge matters and to attend the cremation.


I then confirmed from J. Jayant Mehta's court that he had only 3 matters left after lunch, two of which he had posted for arguments t 2:15 pm and the third was a new transfer petition.


At 2:15, J. Pratibha Rani again sat in a single Bench in court 26. She finished her passed over matters. When she was about to get up, I inquired when the Special Bench would sit. To my shock, she was unnecessarily, curt, rude and hostile to me, scolding me for troubling her and asking the question again because according to her she had already indicated that the Special DB would sit at 2:30.


I waited in court. Manpreet Lamba and Om Prakash also came to the court.


At around 2:45 pm, J. Pratibha Rani summoned her court master (Anil Kumar Singh) who then came out and informed us that J. Jayant Nath was not available after lunch and the DB would not therefore sit. I requested that the matter be adjourned to the next day, but the court master insisted that he had instructions to adjourn the matter to 8 January 2015. He refused to post the matter tomorrow and further also insisted that the hearing already fixed for 17 December 2015 was being cancelled. I protested against cancellation of the 17 December hearing as this could only be done by the DB itself which was not going to sit. After I complained to the Registrar General about this, the court master appeared to take instructions from J. Pratibha Rani and informed me that the hearing fixed for 17 December 2014 was not being cancelled and that was the next date. My repeated requests to the court master that the matter was urgent and be adjourned to the next day were ignored. I point out that the procedure is that in case of urgent matters, if the Bench does not sit for any reason, the matters are usually adjourned to the next day.


I am being poisoned, I am homeless and being targeted, I need urgent witness and whistleblower protection and I have an application seeking Z+ security filed on 20 November 2014 and seeking day to day hearings of this matter. This application is still to be heard.

 

J. Jayant Nath was supposed to attend court post lunch. He suddenly changed his plans and took half the day off. I would like to know why and when did he suddenly decide not to resume work after lunch.


J. Pratubha Rani has conveyed that she is not interested in hearing this matter. She attempted to get this matter pushed off to January 2015 and to also cancel the hearing fixed for 17 December 2014. She also displayed hostility towards me even before any hearing of the matter.

 

J. Pratibha Rani's instructions to her court master today which have further delayed hearing of this matter until 17 December 2014 result in me remaining without protection and security for another week and provide an additional opportunity of one week to poison me.

 

If this matter is not immediately heard on a day to day basis, I will end up either dead or hospitalized due to ongoing poisoning. Is J. Pratinha Rani going to accept responsibility for my being poisoned between today and 17 December 2014? 


 I am even being exposed to toxic chemicals by Delhi Police security personnel and Rajasthan Armed Constabulary personnel on Delhi High Court premises.

 

In these circumstances, since J. Pratibha Rani is not inclined to hear this matter and her position puts me at risk, she should release this matter forthwith so that it can be heard by a different Bench. She has also displayed a hostile attitude towards me in court today.

 

If J. Jayant Nath also decided to not work after lunch today to prevent this matter from being heard then he too should recuse himself.

The matter will now be listed in court on 17 December 2014.

 

I would also like to know if Delhi High Court rules allow for a Division Bench to be comprised of two additional judges who have both still to be appointed as permanent judges. Both J. Pratibha Rani and J. Jayant Nath are junior judges who have not been confirmed as permanent judges. Why is Chief Justice Rohini hesitant to list the matter before a Division Bench headed by her?

 

Today's behaviour by J. Pratibha Rani is an example of her inexperience as she has never presided over a Division Bench before.

Today there was no court hearing in WP Civil 1290/ 2012, the corruption case filed by me against General Electric Company & Others as the Special Division Bench of J. Pratibha Rani and J. Jayant Nath did not assemble. The next date of hearing is 17 December 2014.


I describe below what transpired today. At around 12 pm, I asked J. Pratibha Rani in Court 26 when the Special Division Bench would sit. She first told me that the matter would not be heard today and her reasons were that she was unwell, she had to attend J. Sanjiv Sachdeva's mother's cremation etc. She wanted to adjourn the matter to January 2015. I insisted that the matter was urgent and needed to be heard. She then indicated that the Special Bench would convene at 2:30 pm.


Several judges attended the cremation of J. Sanjiv Sachdeva's mother at 12:30, but they all held court after lunch.


J. Pratibha Rani looked perfectly well and was well enough to hear all her single judge matters and to attend the cremation.


I then confirmed from J. Jayant Mehta's court that he had only 3 matters left after lunch, two of which he had posted for arguments t 2:15 pm and the third was a new transfer petition.


At 2:15, J. Pratibha Rani again sat in a single Bench in court 26. She finished her passed over matters. When she was about to get up, I inquired when the Special Bench would sit. To my shock, she was unnecessarily, curt, rude and hostile to me, scolding me for troubling her and asking the question again because according to her she had already indicated that the Special DB would sit at 2:30.


I waited in court. Manpreet Lamba and Om Prakash also came to the court.


At around 2:45 pm, J. Pratibha Rani summoned her court master (Anil Kumar Singh) who then came out and informed us that J. Jayant Nath was not available after lunch and the DB would not therefore sit. I requested that the matter be adjourned to the next day, but the court master insisted that he had instructions to adjourn the matter to 8 January 2015. He refused to post the matter tomorrow and further also insisted that the hearing already fixed for 17 December 2015 was being cancelled. I protested against cancellation of the 17 December hearing as this could only be done by the DB itself which was not going to sit. After I complained to the Registrar General about this, the court master appeared to take instructions from J. Pratibha Rani and informed me that the hearing fixed for 17 December 2014 was not being cancelled and that was the next date. My repeated requests to the court master that the matter was urgent and be adjourned to the next day were ignored. I point out that the procedure is that in case of urgent matters, if the Bench does not sit for any reason, the matters are usually adjourned to the next day.


I am being poisoned, I am homeless and being targeted, I need urgent witness and whistleblower protection and I have an application seeking Z+ security filed on 20 November 2014 and seeking day to day hearings of this matter. This application is still to be heard.

 

J. Jayant Nath was supposed to attend court post lunch. He suddenly changed his plans and took half the day off. I would like to know why and when did he suddenly decide not to resume work after lunch.


J. Pratubha Rani has conveyed that she is not interested in hearing this matter. She attempted to get this matter pushed off to January 2015 and to also cancel the hearing fixed for 17 December 2014. She also displayed hostility towards me even before any hearing of the matter.

 

J. Pratibha Rani's instructions to her court master today which have further delayed hearing of this matter until 17 December 2014 result in me remaining without protection and security for another week and provide an additional opportunity of one week to poison me.

 

If this matter is not immediately heard on a day to day basis, I will end up either dead or hospitalized due to ongoing poisoning. Is J. Pratinha Rani going to accept responsibility for my being poisoned between today and 17 December 2014? 


 I am even being exposed to toxic chemicals by Delhi Police security personnel and Rajasthan Armed Constabulary personnel on Delhi High Court premises.

 

In these circumstances, since J. Pratibha Rani is not inclined to hear this matter and her position puts me at risk, she should release this matter forthwith so that it can be heard by a different Bench. She has also displayed a hostile attitude towards me in court today.

 

If J. Jayant Nath also decided to not work after lunch today to prevent this matter from being heard then he too should recuse himself.

The matter will now be listed in court on 17 December 2014.

 

I would also like to know if Delhi High Court rules allow for a Division Bench to be comprised of two additional judges who have both still to be appointed as permanent judges. Both J. Pratibha Rani and J. Jayant Nath are junior judges who have not been confirmed as permanent judges. Why is Chief Justice Rohini hesitant to list the matter before a Division Bench headed by her?

 

Today's behaviour by J. Pratibha Rani is an example of her inexperience as she has never presided over a Division Bench before.

The cause list of the Delhi High Court for today shows the captioned matter Writ Petition (Civil) 1280/ 2012 – in the matter of Seema Sapra v. General Electric Company and Others listed before a Special Division Bench of J. Pratibha Rani and J. Jayant Nath in Court 26 today, i.e., on 10 December 2014. The listing before J. Midha and J. Jayant Nath has been cancelled. But this would mean that J. Pratibha Rani and J. Jayant Nath would not have had an opportunity to even open the court record in this case before today's hearing, which has once again been effectively sabotaged. The last date of hearing was 2 December, more than sufficient time for Listing Registrar Lorren Bamniyal to have ensured proper marking by Chief Justice Rohini. However, Lorren Bamniyal has again been used to sabotage the hearing in this matter.

Yesterday, toxic chemicals were again released next to me in the Delhi High Court and were also introduced into my car while it was parked outside the Delhi High Court.

There is a threat to my life and I am being denied a hearing in the matter. Kindly bring this to the notice of the Chief Justice so that the matter is marked to a different Bench. Seema Sapra"


The court record in this whistleblower corruption petition is attached. There are now 35 volumes of pleadings. 


The application filed by me against the fraudulent, unauthorised arbitration before Mr Deepak Verma - numbered as CM 20069/2014 - is also listed before Court tomorrow along with the writ petition and all pending applications.
