To the Chief Justice of the Delhi High Court and to the Registrar General of the Delhi High Court,
I reproduce below an order passed by J. Rajiv Shakdher in WP C 1280/ 2012 on 8 November 2012 on my application CM 18325/ 2012. CM 18325/ 2012 was filed because the paper court record in this matter was deliberately being destroyed. Papers including affidavits were being damaged due to faulty punching and faulty maintenance, storage, handling and upkeep of the files. Several pages were torn and these had to be fixed using cello-tape after the order below was passed. A copy of CM 18325/ 2012 is attached.
Since then on several occasions, I have had to make further complaints that the paper court record was still being damaged.
Now the court record is being scanned and an electronic record is being maintained, however the original paper records still must be maintained properly.
While the matter was being listed before J. Sistani and J. Pathak, I noticed on 20 November, 1 December and on 2 December 2014 that some pages were sticking out at odd angles from the files and were getting damaged. I did not get an opportunity then to raise this issue.
This matter was listed before J. Pratibha Rani and J. Jayant Nath on 10 December and I saw the complete court record lying on the floor of court 26 right in front of the court master Anil Kumar Singh. At around 11:30 am, J. Pratibha Rani left the court room for 15 minutes. In that interval I saw that the files had been carelessly dumped on to the floor in bundles in a manner that files were piled on top of each other bound together and files at the bottom were getting twisted and torn. The files were not horizontal in the bundle as they should have been. Instead the bundles had been thrown to the floor from a height. I also noticed that several pages were sticking out of the files. I complained to the court master and insisted that he ask someone to straighten the files. I also noticed that in 2 folders, the first page of affidavits filed by me had been pulled out of the folder and were getting torn. These two pages were straightened in court at that time by a court peon in front of several lawyers present in court. The court master tried to avoid responsibility by saying that the registry was responsible for the files and not him. I asked the court master to call the dealing assistant to court from the writ branch so that the papers could be properly filed and inserted in the folders to prevent further damage.
The court master took no further steps to rectify the situation.
As a result, at 3:10 pm I was forced to take photographs of the files showing pages still sticking out from the folders and getting damaged. Three pictures are attached. These pictures show papers sticking out of the folders and getting damaged.
Needless to say this amounts to contempt of court by court and registry staff including the court master Anil Kumar Singh.
I point out that it can be no coincidence that in two folders, the one sheet of paper sticking out and getting torn was the first page of an affidavit filed by me. This means original affidavits filed by me are being deliberately damaged.
This is a corruption matter in which court and registry staff are being deliberately used to destroy the court files.
I will be moving a contempt petition in this matter against the court registry and officers.
Meanwhile I ask that I be permitted to take photographs of the court files to show how papers have been damaged and torn.
I also request that the Registrar General herself call for the complete court file (35 volumes) and after examining it, issue directions that the file be properly maintained, and the damaged papers be fixed using cello-tape or another appropriate method.
The registry is also still not maintaining a complete and proper index of applications and documents filed in this matter despite explicit court orders to this effect passed by J. Rajiv Shakdher on 8 November 2012.

There are three prayers made in the application. In so far as prayer (a) and (c) are concerned, it goes without saying that the registry is obliged to maintain proper records pertaining to the writ petition in issue, which includes, the documents filed. The registry is also directed to maintain a proper and a complete index of documents filed in the registry.
In so far as prayer (b) is concerned, Ms Sapra submits that these are Emails which have been sent various authorities with a copy to the High Court. She agrees that these emails should either not form a part of the court record or, if they are made part of the court record, all the Emails should be placed on record.
I agree with her first submission that the Emails addressed to other parties, unless so directed by the court should not be placed on the court's record. The registry is directed to remove all such Emails filed by the petitioner from the court's record.
The application stands disposed of."

To the Chief Justice of the Delhi High Court and to the Registrar General of the Delhi High Court,
I reproduce below an order passed by J. Rajiv Shakdher in WP C 1280/ 2012 on 8 November 2012 on my application CM 18325/ 2012. CM 18325/ 2012 was filed because the paper court record in this matter was deliberately being destroyed. Papers including affidavits were being damaged due to faulty punching and faulty maintenance, storage, handling and upkeep of the files. Several pages were torn and these had to be fixed using cello-tape after the order below was passed. A copy of CM 18325/ 2012 is attached.
Since then on several occasions, I have had to make further complaints that the paper court record was still being damaged.
Now the court record is being scanned and an electronic record is being maintained, however the original paper records still must be maintained properly.
While the matter was being listed before J. Sistani and J. Pathak, I noticed on 20 November, 1 December and on 2 December 2014 that some pages were sticking out at odd angles from the files and were getting damaged. I did not get an opportunity then to raise this issue.
This matter was listed before J. Pratibha Rani and J. Jayant Nath on 10 December and I saw the complete court record lying on the floor of court 26 right in front of the court master Anil Kumar Singh. At around 11:30 am, J. Pratibha Rani left the court room for 15 minutes. In that interval I saw that the files had been carelessly dumped on to the floor in bundles in a manner that files were piled on top of each other bound together and files at the bottom were getting twisted and torn. The files were not horizontal in the bundle as they should have been. Instead the bundles had been thrown to the floor from a height. I also noticed that several pages were sticking out of the files. I complained to the court master and insisted that he ask someone to straighten the files. I also noticed that in 2 folders, the first page of affidavits filed by me had been pulled out of the folder and were getting torn. These two pages were straightened in court at that time by a court peon in front of several lawyers present in court. The court master tried to avoid responsibility by saying that the registry was responsible for the files and not him. I asked the court master to call the dealing assistant to court from the writ branch so that the papers could be properly filed and inserted in the folders to prevent further damage.
The court master took no further steps to rectify the situation.
As a result, at 3:10 pm I was forced to take photographs of the files showing pages still sticking out from the folders and getting damaged. Three pictures are attached. These pictures show papers sticking out of the folders and getting damaged.
Needless to say this amounts to contempt of court by court and registry staff including the court master Anil Kumar Singh.
I point out that it can be no coincidence that in two folders, the one sheet of paper sticking out and getting torn was the first page of an affidavit filed by me. This means original affidavits filed by me are being deliberately damaged.
This is a corruption matter in which court and registry staff are being deliberately used to destroy the court files.
I will be moving a contempt petition in this matter against the court registry and officers.
Meanwhile I ask that I be permitted to take photographs of the court files to show how papers have been damaged and torn.
I also request that the Registrar General herself call for the complete court file (35 volumes) and after examining it, issue directions that the file be properly maintained, and the damaged papers be fixed using cello-tape or another appropriate method.
The registry is also still not maintaining a complete and proper index of applications and documents filed in this matter despite explicit court orders to this effect passed by J. Rajiv Shakdher on 8 November 2012.

There are three prayers made in the application. In so far as prayer (a) and (c) are concerned, it goes without saying that the registry is obliged to maintain proper records pertaining to the writ petition in issue, which includes, the documents filed. The registry is also directed to maintain a proper and a complete index of documents filed in the registry.
In so far as prayer (b) is concerned, Ms Sapra submits that these are Emails which have been sent various authorities with a copy to the High Court. She agrees that these emails should either not form a part of the court record or, if they are made part of the court record, all the Emails should be placed on record.
I agree with her first submission that the Emails addressed to other parties, unless so directed by the court should not be placed on the court's record. The registry is directed to remove all such Emails filed by the petitioner from the court's record.
The application stands disposed of."
