have already told you that I'm not interested in dealing with you in
any manner.



I will not answer your nonsensical email, except to tell you that only
in an effort to pre-empt / forestall legal action against you (albeit,
without prejudice), you were directed to return the money in a certain
expiatory manner.



You have chosen not to. Very well. That chapter is now closed.



(Your reasons are immaterial to me. In any case, given that money
never remains static, and its intrinsic value increases with every
passing day, it is obvious that your so-called reasons are just
excuses to enable you to enjoy the swelling-by-the-day wrongful gain
stemming from the possession and use of the money for as long as
possible, given that your allegedly broken leg does not prevent you
from going to the Bar Council of Delhi to return the money, but
strangely, prevents you from going to the nearest HDFC or ICICI Bank
branch to do so. Also, I know of no reputed lawyer who is willing to
stand closer than 20 feet from you, meaning, since you also know that
no reputed lawyer is willing to stand closer than the aforesaid
distance from you, that specious suggestion also was made by you only
to enable you to assist you in continuing to enjoy the
swelling-by-the-day wrongful gain garnered by you, by enjoying the
possession and use of the money for as long as possible.)



Now read and understand this : the previous directions to you are now
amended, as the offer is withdrawn, and you are now directed to return
the money to the man you forcibly snatched it from, in breach of his
trust (Mr. Soumen, my general handyman), and at the same place you
snatched it i.e. outside my residence. (In the criminal action that is
intended to be initiated by him against you, it is he who was the
complainant, so even for your own protection, you need to return the
money to him, not to me.)



Meet him only after taking a prior appointment from him and confirming
his convenience to receive you. He is not always free, as his duties
also include taking the house bitch for a walk, bathing her, etc, and
his duties towards the bitch will supersede any time that he can make
available for you.



The return of the money should be no later than 6 pm, Tuesday, July 29th, 2014.



Should you not do so, and by that time, and for any reason(s) you drum
up, I personally guarantee you that acting as pro bono advocate for my
newly-found client (Mr. Soumen), I will strive to ensure that the law
will take its speedy course, and consequently, you may, and in perfect
accordance with law, very well be deprived of your personal liberty at
any time from July 30th, 2014 onwards. (Perhaps the silver lining from
your perspective is that even deprivation of your personal liberty may
not lower your reputation, and in the process, may even give you a
roof over your head, alongwith free food. Be that as it may.)



If you feel that such legal action constitutes filing of a wrongful
complaint on Mr. Soumen's part, I have no doubt you are fully aware of
the provisions of Section 211 read with Section 182 of the Indian
Penal Code, which you can personally recite to Police Commissioner Mr.
B. S. Bassi, given that you know him so well and gaily correspond with
him daily.



Note that your return of the snatched money would be without prejudice
to the right to initiate any action tenable in law.



Furthermore, if you think by writing long emails offering to return
the money (albeit with all sorts of senseless conditions) washes out
your crime and protects you from criminal proceedings, you are very
much mistaken. At the highest, your offers may – repeat, may - dilute
the punishment. The crime was commissioned the moment you snatched the
money out of his hand, and subsequent expiatory offers (even if
genuine and well-meaning, which, in the instant case, they are not)
don't change that.



I have nothing else to say to you. If you still have energy to
respond, why don't you whistle into the wind instead. Or write to the
Delhi Police. Or to the other addressees. Perhaps it may do you more
good, because I most certainly will not bother reading your rubbish
any further, let alone responding to it.



Take good note that, hereafter, I will not be reading any of your
emails, given that they have now been marked for my junk folder,
which, frankly, is better than where they belong. I also will not be
opening any communication from you delivered in any other form, such
as post, courier, etc.



And if you attempt to forcibly meet me and try to communicate with me
orally in person, whether by attempting to block my path or any
suchlike actions, take careful note that I will continue to physically
proceed on my chosen path without slowing down a whit, and in this
process, should any part of your body or clothing make even the
slightest contact with any part of mine because you, despite knowing
and seeing my intended path and my intent not to slow down, had
deliberately chosen to block my already-visible path with your body, I
will deem that conscious and deliberate act on your part as "physical
assault" by you against me and/or attempt at "wrongful restraint" and
related offences on your part, and consequently, I will take immediate
self-preservation action in self-defense accordance with law, which
may include using my hands and/or feet against you to protect my own
body from your "assault" and/or your attempt at committing "wrongful
restraint" against me.



Though you are of the female gender and, in my own opinion, such an
act would not constitute gentlemanly conduct on my part, nonetheless,
physical assault even by a person of your gender assumes a totally
different proportion and standard as far as retaliatory response /
self-defence is concerned.



I may also caution you in advance that since I used to box in school,
college and university, the use of what I call "normal force" (by my
standards) may cause discomfort / pain that may be somewhat more than
what some people can withstand. (As you will appreciate, there is no
"absolute" standard of "normal force", and it varies with physique,
from person to person, and situation to situation, and especially in
case of largely-involuntary actions triggered by self-defense, the
usual restraints are either missing in totality, or are considerably
diluted.)



Therefore, should my involuntary use of tempered (and what I call, by
my standards) "normal force" in such a situation (where I would be
acting in self-defense for self-preservation) be excessive for you, do
not say that you had not been warned well in advance.



Therefore, it is better for you to keep distance from me rather than
escalate a situation to a point where your own unlawful actions result
in injury upon you.



I am endorsing this email to Hon'ble Registrar General of the Hon'ble
Delhi High Court, because if any of the foregoing type of incidents
happen within the premises of the Hon'ble Delhi High Court, after
having acted in self-defense, I will ask her to summon the police
immediately to have you dealt with in accordance with law.

It was a gift and when you asked me if I would return it, I told you I
would if my circumstances ever improved, but that was unlikely, and
that any financial assistance be given on the presumption that it

I asked you for Rs 50000. You told me you needed to check your bank
balance. On your suggestion, I called you twice.

When I called you the day before yesterday, you said you were short of
funds but then agreed to gift me Rs 20000.

I requested that you have it delivered to me. But as you said that was
not possible, I said I would pick it up from your office/ home even
though I wanted to avoid such a drive because of my fracture.

I drove to your house, asked for your staff (Soumen whose name you had
given me) to come out and he handed me the money. He then asked me to
write something on a blank sheet but I said no and that I would call
you to confirm receipt. I was in the drivers' seat and he was near the
left front door so the question of my snatching anything does not
arise. Soumen agreed when I told him I would not sign anything.

I was stuck in traffic, and tired when I got back. I went to sleep at 8 pm.

In any case, it is a good thing that I have not spent the money. I am
glad that your true intention to target me became clear before I spent
the Rs. 20000. I do not want your money.

I am more than happy to return the Rs 20000 to you, but would like to
return it in front of witnesses. Please collect it from me in the
Delhi High Court after arranging a mutually convenient time and place.
Or I can deposit it in court for you in my matter (WP Civil 1280 of
2012) with an application. So that there is a clear record of it

There was no "gift", let alone a voluntary gift. Your suggestions are
laughable, and ridiculous. There is no question of its non-return. You
begged for a loan, explaining how you had been hounded, and that your
leg was fractured, and that you were forced to live in some YWCA or
similar, and that you had no money to pay the room rent or medical
bills. For this purpose, you called me 4 times over 3 days on my cell,
begging each time over protracted conversations for assistance in the
form of a loan so you could pay medical expenses and your rent,
otherwise you would be thrown out on the road. You sought a loan of Rs
50,000. Taking pity on you, but more to just get you off the line, I
offered you Rs. 20,000, also suspecting that you perhaps thought me to
be a soft touch, and so, you had unconscionably inflated your "needs".
You accepted to borrow this sum, and on my query on its return, you
said that you could not immediately confirm a precise date, but
assured that it would be soon, and offered to secure it to my
satisfaction. We left it at that for then. But that does not make the
"loan" a "gift".



You are being needlessly over-clever with a person who, despite having
no interest in you or your causes, agreed in principle to help you, so
now the offer to help you is withdrawn.



When you came to my house yesterday evening, you rang the bell of my
house, and since no one came out immediately, you approached the
neighbour's servant, and got my cook's cell number, and then you
called him on his cell, so he came down to the gate and opened it, to
enable you to come inside. You asked him to come to the car, which he
did. There are witnesses to all this, as there is corroborative
evidence by way of phone calls.



No one asked you to sign a blank piece of paper. You were asked by my
Mr. Soumen to give a receipt for the money. As you nodded in
agreement, he handed over the plain paper for you to prepare the
receipt in your own words. But after you had the paper in your hands,
you reached out and plucked the money out from his hands, and
immediately drove off, criminally betraying the trust on the basis of
which I allowed my representative to hold money for you, and in
effect, committing a criminal act not dis-similar to chain-snatching,
pickpocket, theft, and the like.



And even assuming without admitting that you did say to him that you
would call me confirming that you had "picked up" the money (but which
you did not), you did not call, clearly showing your ill intentions.



As you have misinterpreted the discussion to think you have been
gifted the money, sorry, there is no gift, and you have misunderstood.



Return the money immediately, please. It was forcibly snatched by you
from my representative, who stood trustingly before you on false
pretences put up by you. Given your scandalous behaviour even with
someone who agreed to consider helping you out, I reiterate that I
have no interest in you or your causes whatsoever, hence, I have no
interest in "loaning" you any money, much less "gifting" it to you (as
absurdly suggested by you).



I agreed to consider to help you merely as one advocate to another, as
one human being to another. But by breaching trust and running off
with the money forcibly taken out of my representative's hands, and
now trying to project as if I have "gifted" you money, you have acted
despicably.



You are a distasteful person. No wonder you are in the predicament you are in.



Please do not contact me after this relating to your so-called
cause(s) for any reason, be it GE or anything else. I am not simply
not interested.



If you do not return the money immediately, within today evening, even
though the amount is small, as it's a matter of principle, I assure
you that I shall take all legal steps available to me, no matter what
the cost, which shall be to your risk, as to the cost and
consequences. I also assure you that the Noida Police are quite
proactive when it comes to taking prompt action on criminal offences
like this.



Your cc-ing persons in authority who have no interest or role in the
controversy only brings you into further ridicule. But since you have

see how wonderful a person you are, how she treats people who may have

Reproduced below is an email dated 31-01-2014 forwarded to me from
Advocate Ms. Seema Sapra, with yet another email dated 29-01-2014.
Both have been forwarded to around 400 individuals, both in India and
overseas, both private citizens, Government Officers, as well as
members of the National as well as International media.



In this email, she has categorically stated that, allegedly, Suresh
Kait, J. (a Judge of the Delhi High Court, whose conduct has been
highly questionable on a number of counts, including criminal
offences), sexually harassed a law intern working with him when he had
taken her a few months ago on the State Exchequer's expense to Bhopal
for an event at the National Judicial Academy. It appears from this
email that when the intern allegedly complained about this alleged
sexual harassment to Ld. Registrar General of the Hon'ble Delhi High
Court (Ms. Sangeeta Dhingra Sehgal), instead of the lady Officer
taking action to protect her professional "sister" in accordance with
law, she – acting allegedly in concert with Mr. Amarjit Singh
Chandhiok (ex. Additional Solicitor General) - somehow hushed up the
matter, forcing the complainant to not press her complaint. (This is
perhaps is yet another example that shows how Mr. Chandhiok allegedly
garners professional patronage amongst Judges to advance his own
career, and, of course, his bank balance.)



From the emails, it appears that similar complaints of sexual
harassment against V. K. Jain, J. (ex-Secretary General of the Supreme
Court of India, now Additional Judge of the Delhi High Court) and Mr.
M. L. Mehta (now, retired Additional Judge of the Delhi High Court)
were similarly hushed up.



Sir : if the Judiciary wants respect, it will have to 'earn' it, not
'demand' it (inter alia, by mechanically citing that its Members
occupy 'Constitutional' posts). First, by doing a heinous wrong, and
then, doing a 2nd wrong (by forcing complainants who are the subject /
target of the 1st wrong to 'not press' or 'withdraw' their legitimate
complaints) gives it no credit.



None whatsoever.



Sir : to be appointed as a Judge in India is no sinecure. Yet,
whenever one of its Members is exposed, the Judiciary closes its ranks
so that no action is taken against its erring member, allowing the
public to gain the impression that the post is, indeed, not just a
sinecure, but also brings with the appointment a
"Get-out-of-Jail-free" card (like in the game Monopoly).



This sort of partisan conduct, Sir, where even grave / heinous
criminal conduct goes unpunished, greatly diminishes the standing of
the Judiciary in the eyes of the general public. This diminution is
all the more acute given the manner the Judiciary has "hijacked" the
system of appointment of Judges in a manner that is, in itself, a
total "nullity" in law. Judges today, appointed after 1992, have as
much legal sanctity in relation to their appointment (and the acts
they carry out in judicial office) as, say, the CBI or the IB.



Sir : I request you to kindly have the allegations of sexual
harassment against Suresh Kait, J. promptly investigated in accordance
with law.



The Hon'ble Supreme Court has taken the position in the Justice
Ganguly case that the Supreme Court shall not enquire into allegations
of sexual misconduct against retired Judges. Well, Sir : Suresh Kait,
J. is not a retired Judge ; he is a sitting Judge of the High Court of
Delhi. Therefore, prompt action is warranted.



I may add that the appointment of Suresh Kait as an additional Judge
is a total "nullity" in law, given that it was effected by a Collegium
presided over by K. G. Balakrishnan (ex-CJI), whose daughter - at that
very time - was Kait's junior. Thus, CJI Balakrishnan was acting in
violation of the well-settled maxim nemo judex causa sua, esse debet,
rendering his act of recommending Kait's name to the President as a
"nullity" in law. It is a well-settled legal proposition that if an
initial action is not in consonance with law, all subsequent and
consequential proceedings would fall through, for the reason that
illegality strikes at the root of the subsequent events. Therefore, in
such a situation, the legal maxim "sublato fundamento cadit opus[1]
would come into play (and to the detriment of Kait, J.), meaning
thereby that with the foundation being removed, the structure / work
built thereupon by CJI Balakrishnan also falls.



I shall shortly be filing an RTI to know the fate of this
communication. I hope the reply under the RTI Act will not be that it
has been "consigned to the file", or similar, because if so, your –
i.e. Hon'ble P. Sathasivam (Esquire)'s - partisan action of shielding
and protecting Judges against whom there are serious criminal
allegations would be no different from that of, say, the Ld.
Registrar General of the Hon'ble Delhi High Court.



Whereas, I presume that the moral fabric of the pristine cloak worn by
Hon'ble the Chief Justice of India is woven from thread which is
materially different from that of the proven-shabby cloak worn by the
Ld. Registrar General of the Hon'ble Delhi High Court (who, I am sure,
hopes to be a High Court Judge herself one day).

At 10.30 am today morning, Delhi High Court judges Sudershan Kumar
Misra and Suresh Kait had not signed the order passed yesterday in
court in the captioned matter even though they are required by law to
date and sign orders the day they are pronounced.







I was compelled to mention this issue to the court master of Justice
Sudershan Kumar Misra. The Judge then sat late today at 11.30 am and
signed the order in the captioned matter.







The court record was inspected by me today and I read the order which
has still not been uploaded onto the internet even though this is
required by Delhi High Court rules.







The order is dated 30 January 2014 though it was signed on 31 January

2014 - this technically makes the order a forged document as it is
misleading as to when it was actually signed.







On previous occasions, Division Benches headed by Judge Gita Mittal
and Judge P K Bhasin also failed to sign orders passed in this matter
on the day they were pronounced and these Benches also back-dated
these orders rendering them technically forgeries.







I also attach some more documents pertaining to the criminal offences
and corrupt acts committed by Judge Suresh Kait in Mr Deepak Khosla's
litigation against a powerful individual called Vikram Bakshi who
until recently used to operate McDonald restaurants in North India.







These establish beyond doubt that Judge Suresh Kait is not fit to be a
judge of the Delhi High Court.







Mr Prashant Bhushan has confirmed to me that CJAR's complaint

(attached) to the Chief Justice of India against Judge Suresh Kait has
not been considered. Judge Suresh Kait ought not to have been
confirmed as a permanent judge of the Delhi High Court on 12 April
2013.







Judge Suresh Kait's bio on the website of the Delhi High Court reads:







"Justice Suresh Kait was born on May 24, 1963 at Village Kakaut,
Distt. Kaithal, Haryana, India. Graduated in Humanity from University
College Kurukshetra. During graduation, he was selected as Unit Leader
in National Service Scheme (NSS) and was awarded University Merit
Certificate. Post-Graduated in Political Science from Kurukshetra
University. During Post-Graduation, he was elected as Joint Secretary
of Students' Union, Kurukshetra University. He obtained Bachelor's
Degree in Law from Campus Law Centre, University of Delhi and was
enrolled as an Advocate in the year 1989. Justice Kait is first in the
family who became the Advocate. He had been the Panel Lawyer/Senior
Counsel for U.P.S.C. and Railways. He was appointed as Standing
Counsel for Central Government in the year 2004 and continued till his
elevation. He was elevated as an Additional Judge of Delhi High Court
on 5th September, 2008; and became a Permanent Judge on 12.04.2013."







I have also learnt that a few months ago, an intern working with Judge
Suresh Kait had made a complaint against him to the Registrar General
of the Delhi High Court among others. Judge Suresh Kait took the
intern with him to Bhopal (for an event at the National Judicial

Academy) where he sexually harassed her. The intern's complaint made
upon her return to Delhi was covered up and the intern was compelled
to leave her assignment. Mr A S Chandhiok again reportedly played a
role in covering up this complaint against Judge Suresh Kait.



I will be seeking recusal by Judge Suresh Kait in the captioned matter.

The captioned matter is listed for hearing tomorrow (30 January 2014)

in the Delhi High Court. I have been informed that it will be listed

before a Special Division Bench of Judge S K Mishra and Judge Suresh

Kait.







I am really shocked that this matter has been marked to this Bench by

Chief Justice Ramana.







There are several reasons why I will not get a fair hearing from this Bench:







First, I have in my email titled "Complaint against Swatanter Kumar -

message to Chief Justice of India from General Electric whistleblower

and advocate - Seema Sapra - Writ Petition (Civil) 1280/ 2012 - in the

matter of Seema Sapra v. General Electric Company and Others in the

Delhi High Court" and dated 14 January 2014 addressed to the Chief

Justice of India to Chief Justice Ramana, to the Bar Council of Delhi,

to the Registrar General of the Delhi High Court and among others to

the Delhi Police Commissioner stated the following:







"To the Bar Council of Delhi, to the Chief Justice of India, to the

Chief Justice of the Delhi High Court, to the Registrar General of the

Delhi High Court, to the Police Commissioner for Delhi, and to All

I have filed a whistle-blower corruption and right to life Writ

Petition pending in the Delhi High Court since February 2012 - Writ

Petition (Civil) 1280/ 2012 - in the matter of Seema Sapra versus

General Electric Company & Others.







CM 2477/ 2013 (attached) pending in this matter also seeks the following relief:







"Direct the Government of India (Respondent no. 5 herein) to act on

the Petitioner's complaint forwarded to the President and Prime

Minister of India by email dated February 12, 2013 and to constitute a

high level complaints committee in accordance with the Supreme Court's

directions in Vishaka & Others v. State of Rajasthan & Others and in

Medha Kotwal Lele and Others v. Union of India and Others to redress



the petitioner's complaint of sexual harassment against Mr Soli j

Sorabjee, when the latter held the constitutional post of Attorney

General of India".







I am writing in connection with the complaint of sexual harassment

made by a female intern against retired Supreme Court of India Judge

Swatanter Kumar.







I request that this complaint be properly investigated in accordance

with law and that the matter not be brushed under the carpet as

suggested by Mr Harish Salve.







I am shocked to see the likes of Soli J Sorabjee and Rajiv Dhawan

attacking the intern in news interviews and coming to the support of

Swatanter Kumar.







Several lawyers have confirmed that (sitting Delhi High Court Judge)

Gita Mittal and Swatanter Kumar were in a sexual relationship when she

was his junior and also after







Swatanter Kumar became a judge. Swatanter Kumar then used his judicial

position to have Gita Mittal appointed as a Delhi High Court judge.

When Gita Mittal's name for a judicial appointment was being

considered, some lawyers had distributed pamphlets in the Delhi High

Court that Gita Mittal and Swatanter Kumar (then in Chandigarh High

Court) had been secretly meeting in a resort midway between Chandigarh

and Delhi for their sexual assignations.







I was told by several lawyers that Gita Mittal is corrupt and can be

approached either directly or through Swatanter Kumar.







I have also learnt that Delhi High court staff including court

stenographers had also complained about Swatanter Kumar's

inappropriate behaviour when he was a Delhi High court judge.







Many other lawyers openly corroborate the reputation of Swatanter

Kumar as a sexually licentious man who has a history of using his

position as a judge to sexually exploit staff, interns, lawyers and

even women officers from the lower judiciary. One Delhi High Court

lawyer told me that Swatanter Kumar was "habituated" to this kind of

behaviour. Another woman lawyer informed me that while in the Bombay

High Court, Swatanter Kumar was always found in hotel rooms and that

he had destroyed the careers of several woman magistrates who had

refused to succumb to his demands for sexual favours and

gratification.







There seems to be a male lobby of powerful lawyers and judges who have

been sexually exploiting women lawyers and court staff and who come to

each other's defence when charges get levelled against any one of

them.







Rajiv Dhawan was accused in 2000 of sexual harassment and assault by a

young lawyer working in an NGO headed by him called PILSAARC. Rajiv

Dhawan had not only attempted to force himself upon this lady but had

beaten her when she resisted and had even banged her head against the

wall. She had bruises all over her body after this assault. This

matter was hushed up with the help of Soli J Sorabjee. The lady was



pressured to accept money from Rajiv Dhawan and to withdraw her

complaint. She was hounded out of the profession and no one knows

where she is now. Rajiv Dhawan was protected and is still strutting

around the corridors of the Supreme Court of India and is publicly

defending other prominent persons like Swatanter Kumar accused of

sexual misconduct.







Soli J Sorabjee has a long history of sexually exploiting his juniors

and several lawyers and this is open knowledge in the corridors of the

Supreme Court of India and the Delhi High Court.







In 2001, Soli Sorabjee sexually harassed me as described in CM 2477/

2013 pending in WP Civil 1280/ 2012.







In 2013, Soli J Sorabjee is busy publicly defending both A K Ganguly

and Swatanter Kumar (both retired Supreme Court of India Judges)

against charges of sexual assault and sexual harassment.







I was sexually harassed by Raian Karanjawala around 1999 and he is the

person who recommended that I work with Soli J Sorabjee. Raian

Karanjawala was aware that Soli J Sorabjee had sexually harassed me.







Raian Karanjawala has had sexual relations with his female juniors

over several years. One of them Nandini Gore is rumoured to have borne

him a son (Rahul Gore) whose facial features resemble Raian

Karanjawala and not Nandini Gore's husband. See the attached

photographs.







In 2009-2010, I heard rumours that Raian Karanjawala had had a sexual

relationship with one of his juniors called Niharika Aditi Nanda.

While working at Karanjawala & Co. for briefly in 2010, it also

appeared to me that Raian Karanjawala was sexually involved with

another junior working in his office Manasi Gupta.







Raian Karanjawala is now defending Tarun Tejpal in his rape criminal

case. Raian Karanjawala's law firm also sent the intimidating notice

on behalf of Swatanter Kumar to silence the media from reporting on

the intern's charges of sexual harassment against Swatanter Kumar.







Sexual harassment charges levelled against sitting Delhi High Court

judges (V K Jain and Suresh Kait) and recently retired Delhi High

Court Judge (M L Mehta) were covered up without a proper enquiry and

after pressurizing the complainants to withdraw their complaints.

DHCBA chairman A S Chandhiok played a role in this cover-up.







I am shocked that a man of Swatanter Kumar's proclivity was not only

appointed as a judge but went on to act as Chief Justice of the Bombay

High Court, a judge of the Supreme Court and is now heading the

National Green Tribunal. Lawyers like Harish Salve (who was Soli J

Sorabjee's junior) use and exploit this weakness of Swatanter Kumar to

obtain favourable court orders. I am concerned that Harish Salve's

involvement in the matter involving the complaint against Swatanter

Kumar is intended to cover up this complaint and to protect Swatanter

Kumar."







I reiterate that I have stated the following against Justice Suresh

Kait in this email complaint dated 14 January 2014 which has been

widely circulated by me among lawyers and the Press:







"Sexual harassment charges levelled against sitting Delhi High Court

judges (V K Jain and Suresh Kait) and recently retired Delhi High

Court Judge (M L Mehta) were covered up without a proper enquiry and

after pressurizing the complainants to withdraw their complaints.

DHCBA chairman A S Chandhiok played a role in this cover-up."







I will not obtain a fair hearing from J. Suresh Kait and reasonably

apprehend that he will be prejudiced towards me, will bear malice

towards me, and will be vindictive towards me.







A copy of this email complaint is part of the affidavit dated 21

January 2014 filed by me in the captioned matter.







Second, J. Suresh Kait has already been exposed as a corrupt judge who

had falsified records of court proceedings and court orders in the

matter of Mr Deepak Khosla and when Mr Deepak Khosla had produced

evidence of this misconduct, J. Suresh Kait passed vindictive orders

to victimise Deepak Khosla. Contempt of court proceedings are pending

against J. Suresh Kait in the Delhi High Court. Prominent lawyers like

Prashant Bhushan complained to the Chief Justice of India against

Judge Suresh Kait and requested the withdrawal of all judicial work

from J. Suresh Kait. A copy of the complaint dated 21 February 2012

against Judge Suresh Kait made by the Campaign for Judicial

Accountability and Reforms and signed by its convenor Mr Prashant

Bhushan is attached.







It is shocking that a corrupt, vindictive and dangerous man like J.

Suresh Kait is still being allocated judicial work in the High Court

of Delhi.







Third why has Chief Justice Ramana constituted a Special Division

Bench headed by Justice S K Mishra who is not senior enough to be

heading a regular Division Bench?







There are at least two Delhi High Court judges senior to Justice S K

Mishra who could have heard this matter and this matter should have

been allocated to a Division Bench headed by either of them, i.e.,

either Chief Justice Ramana himself or Justice Sistani.







Why has this matter been marked to a Division Bench presided over by

J. S K Mishra who does not enjoy a clean reputation amongst Delhi High

Court lawyers and is perceived as corrupt.







I will be asking this Bench tomorrow to recuse itself from hearing this matter.







It is shocking that Chief Justice Ramana has deliberately put me in

this position of having to appear in a Division Bench of which Judge

Suresh Kait is a member.
