I request registration of FIR for forgery of the document filed in Delhi High Court in Writ Petition Civil 1280/2012 on 28 January 2015 by lawyer Nanju Ganpathy under filing diary number 37442/2015 and falsely described in the court filing as "Copy of Power of Attorney of GE India Industrial Private Limited dated 8 December 2014"; and I request witness protection in respect of this complaint for myself as the Complainant Ms Seema Sapra
A copy of this forged document which has been falsely described as a Power of Attorney dated 8 December 2014 of GE India Industrial Private Limited is attached (Annexure 1).
This copy was emailed to the Complainant Seema Sapra by lawyer Nanju Ganpathy on 2 February 2015. A copy of this email dated 2 February 2015 sent by Nanju Ganpathy to Seema Sapra is attached (Annexure 2).
A copy of the Delhi High Court case history showing a filing by Nanju Ganpathy in Delhi High Court Writ Petition Civil 1280/2012 on 28 January 2015 is also attached (Annexure 3).
This forged document was filed by Nanju Ganpathy in the Delhi High Court in Writ Petition Civil 1280/2012 on 28 January 2015 and was intended to mislead the Court that one K R Radhakrishnan was the power of attorney holder and authorised signatory of GE India Industrial Private Limited in Delhi High Court Writ Petition 1280/2012.
A mere perusal of this forged document establishes that it is a forgery. It is not on non-judicial stamp paper. It is un-notarized. The first and second page have been taken from two different documents and fraudulently attached together. The margins of page 2 have been cut off, with intent to hide the missing part of page 2. There is no reference to Writ Petition Civil 1280/2012 in this document. The original was never produced in Court. Authorization documents filed in the same case earlier for GE India Industrial Private Limited and for its parent Company General Electric Company (now operating as GE Aerospace) were also forged and invalid. Similarly, authorization documents filed in the same case earlier for a sister company GE India Global Sourcing Private Limited were also forged and invalid.
Delhi Police is requested to register an FIR for forgery of this document under the relevant provisions of the BNS, the BNSS and/ or the IPC and Cr. P. C as applicable.
Delhi Police is also requested to provide me witness protection as this forged document and my complaint that this is a forged document places my life in grave and immediate danger.
The forgery of this document and its filing in Delhi High Court Writ Petition Civil 1280/2012 also amount to shareholder fraud under US Securities Law as the parent company General Electric Company is a US corporation traded on the New York Stock Exchange. This offence of forgery will also attract criminal liability under US criminal laws and jurisdiction.
Please note that there is no limitation period in respect of a complaint of forgery.
Please note that the Delhi High Court Judgment in Writ Petition Civil 1280/2012 has not considered or issued a finding on the complaint that this is a forged document.
Please also note that because of this forged document (and indeed for several other reasons) the judgment issued by the Delhi High Court in Writ Petition Civil 1280/2012 is vitiated by fraud on the Court and such judgment is null and void and liable to be confirmed as such by any Court at any time.
Please note that K R Radhakrishnan impersonated as the authorised signatory of GE India Industrial Private Limited in Writ Petition Civil 1280/2012 based upon this forged document. K R Radhakrishnan was used to file forged and false affidavits in Writ Petition Civil 1280/2012. Advocate Nanju Ganpathy knowingly and wilfully impersonated as the Counsel for GE India Industrial Limited in Delhi High Court Writ Petition Civil 1280/2012.
