Subject: Request for urgent early listing of Writ Petition Civil No. 1200/2017 before the Hon'ble Supreme Court in the first/ second week of January 2018
Dear Sir,
1. The captioned matter was registered as Writ Petition Civil 1200/2017 on 9 December 2017 by the Supreme Court Registry.
2. As is evident from a reading of the writ petition, this is an urgent right to life Article 21 Petition under Article 32 of the Constitution of India involving a woman lawyer/ whistleblower and complainant of sexual harassment, and seeks relief to stop the commission of ongoing grave crimes against the Petitioner.
3. As the petitioner is an advocate enrolled with the Bar Council of Delhi (enrollment number D/ 1159/1995), she is exempt from the requirement of an interaction/interview prior to being granted permission to appear and argue in person.
4. The Petitioner's Bar Council card has expired and is also misplaced. Attached as proof of enrollment is a true copy of the print-out of the screenshot of the petitioner's active enrollment status as available on the website of the Bar Council of Delhi as on 11 December 2017. See screenshot attached as Annexure Letter-1.
5. Secondly the petition is very urgent and needs an early hearing.
6. For unclear reasons, the Supreme Court website case status of this matter is showing a computer generated likely listing before a Registrar on 12 February 2018. See screenshot attached as Annexure Letter-2.
· The Supreme Court's own circular dated 5 December 2017 states that fresh matters registered on 9 December 2017 will be listed for hearing before court in the first two weeks of January 2018. See circular dated 5 December 2017 attached hereto as Annexure Letter-3. This circular also applies to matters filed by petitioners in person as the first sentence of this circular includes Party-in-Person.
7. You are requested to dispense with the requirement for an interaction or interview as I am an enrolled advocate and have filed this matter as petitioner in person. An attested affidavit dated 12 December 2017 affirming that I am an enrolled advocate with the Bar Council of Delhi with enrollment number D/1159/1995 is annexed hereto as Annexure Letter-4.
8. My advocate enrolment status is also confirmed by the Delhi High Court judgment dated 17 December 2015 passed in Contempt Case Criminal 2 of 2014 from which an appeal is pending before the Supreme Court of India under diary number 10342/2016 and which is due to be next listed in February 2018.
9. Being an enrolled advocate, as per the Supreme Court Registry practice and procedure, I am not required to undergo an interview/ interaction with the Registrar for my application seeking permission to appear and argue in person in this matter.
10. The Hon'ble Supreme Court has permitted me to appear and argue in person in my Criminal Appeal filed under diary number 10342/2016 by order dated 9 October 2016. No prior interview took place in that matter.
11. I therefore request that Writ Petition Civil No. 1200/2017 be listed before the Hon'ble Supreme Court for hearing in the first or second week of January 2018.
12. You are also requested to dispense with the prescribed length of notice period (if any) for a petitioner in person and are requested to list this matter before Court in the first two weeks of January 2018.
13. There is grave urgency in the matter.
