J. Karnan had written an open letter to the Prime Minister accusing 20 Judges of the Madras High Court of corruption. This letter was addressed to the executive and not to the Supreme Court. The Supreme Court ought to have ignored this letter. The writing of such a letter ipso facto cannot amount to contempt of court because the charges made therein could (hypothetically speaking) be true. 

Instead a seven Judge Bench of the Supreme Court issued a contempt of court notice to J. Karnan for the letter but without mentioning it. Ideally J. Karnan ought to have appeared before the Supreme Court and he should have argued the case for his defense and the Supreme Court ought to have heard him. But before any of this could happen, the seven-Judge Bench of the Supreme Court passed an ex-parte order against J. Karnan without notice to him, that directed that he was barred from performing any judicial or administrative functions as a Judge of the Calcutta High Court. This order violated natural justice. This order was not within the parameters of possible orders or punishments under the Contempt of Court's Act. And most importantly, this order violated the Constitution of India.

A High Court Judge like Justice Karnan is appointed under a Presidential warrant and derives his judicial powers directly from the Constitution of India and not from the Supreme Court. A High Court Judge cannot be removed from his office by the Supreme Court. He can only be impeached by Parliament. The Supreme Court cannot do indirectly that which it is prohibited by the Constitution from doing directly. The Supreme Court cannot take away judicial power from a High Court Judge who remains a Judge under a valid Presidential warrant of appointment. The Supreme Court cannot take away judicial powers which it cannot confer. Therefore, the Supreme Court's orders directing that J. Karnan could no longer function as a Judge of the High Court were illegal and unconstitutional. Note that even in the case of contempt proceedings against lawyers, the Court cannot at the ex-parte stage debar the lawyer from legal practice. 

J. Karnan ought to have appeared before the Supreme Court and ought to have argued why his letter to the Prime Minister could not or did not amount to contempt of court. He should also have contended before the Supreme Court that its orders purporting to take away his judicial powers were unconstitutional and invalid. 

Instead J. Karnan made the mistake of refusing to appear and defend himself before the Supreme Court. Was he being misguided by some lawyers? Was he being drugged? These things happen. 

Instead, J. Karnan elected to continue to exercise his judicial powers and passed retaliatory orders against the seven Supreme Court Judges hearing the suo-moto contempt case. While under the Constitution, J. Karnan was technically correct in his position that he was still a High Court Judge who derived his judicial powers from the Constitution, yet strategically these retaliatory orders were a mistake as the executive and the police ignored J. Karnan's orders. No authority executed his orders. He was functioning without the assistance of the High Court registry. Justice Karnan of course also violated natural justice by purporting to pass orders in his own cause. 

From a purely technical constitutional law position, all of J. Karnan's orders passed after the Supreme Court order barring him from judicial work, could only have been challenged in appeal. Any other position would defeat the independence guaranteed to High Court Judges under the Constitution. The Supreme Court has set a dangerous precedent in this case: that it can take away judicial powers from a High Court Judge. This position adopted by the Supreme Court of India violates the Constitution which provides that a High Court Judge can only be removed from his position by the Parliament. No doubt the orders that J. Karnan continued to "pass" were problematic, but J. Karnan's basic understanding of the constitutional position was not incorrect. 

As stated before, the mistake J. Karnan made was in refusing or failing to defend himself before the Supreme Court. This made it possible for lawyers like Fali Nariman, Ram Jethmalani and K K Venugopal to call J. Karnan mentally unbalanced and a "lunatic". This also led to the Supreme Court being encouraged by K K Venugopal to pass an order that J. Karnan be medically examined to ascertain his mental health. The Supreme Court went on to pass a completely unjustified order directing that J. Karnan be examined by a team of doctors and that the Police provide assistance for such examination. J. Karnan refused to submit to this examination and informed the team of doctors in writing that he was mentally stable. 

J. Karnan's final mistake was in again failing to appear before the Supreme Court today. In his absence, the Supreme Court has now pronounced him guilty of contempt of court and has sentenced him to imprisonment for the maximum period of six months permitted under the Contempt of Court's Act. This order, it must be pointed out, has been passed without giving J. Karnan a proper hearing. This order appears to have been passed not only for the original letter that J. Karnan wrote but also for all his subsequent actions including his subsequent retaliatory "judicial" orders and his press statements. 

In my opinion, having initiated the contempt case, the Supreme Court ought to have compelled J. Karnan's presence before them using non-bailable warrants if necessary. The Supreme Court should have heard J. Karman and then passed final orders. The Supreme Court should at the very least have asked J. Karnan the question – why did he write the 'offending' letter that was the reason for the suo-moto contempt notice issued to him. 

I fear that J. Karnan will be drugged and maybe even poisoned in prison during these six months and he will not be himself when he is released. 

All in all, the entire affair is unfortunate. The Supreme Court has violated the Constitution. Its orders have damaged judicial independence. No Judge will ever dare to expose judicial corruption fearing the same fate as J. Karnan. The wrong precedent set by the Supreme Court could in the future be used by the executive to seek similar orders against an upright but inconvenient High Court or Supreme Court Judge. Judicial orders could be used in the future to take away judicial powers from any High Court or Supreme Court Judge for any number of possible reasons. 
Parliament's exclusive powers have been infringed upon by the Supreme Court of India. What if Parliament were to approach the Supreme Court and claim that the Supreme Court had infringed upon Parliament's territory and trespassed into the domain exclusively reserved for Parliament. The Supreme Court's orders in J. Karnan's case violate the principle of separation of powers under our Constitution. 

In the 1990s, the Supreme Court of India used judicial orders to create the extra-constitutional collegium system and it assumed to itself the power to appoint Judges. Now in 2017, the Supreme Court is creating new extra-constitutional powers for itself and is assuming to itself the power to indirectly remove High Court Judges by judicial orders that restrain such judges from exercising judicial powers. Note that this power could also be available against a Supreme Court Judge. Could seven Supreme Court Judges sitting together judicially restrain another Supreme Court Judge from exercising his judicial powers?

The first instance of a sitting High Court Judge being jailed in India is not a case where the said Judge was accused of corruption or wrong-doing. Instead it is a case, where a Judge who accused other Judges of corruption and wrong-doing is being sent to jail, without any inquiry into his complaints of corruption and wrongdoing against other judges. The system works to protect itself. 

The Supreme Court Judges have also pre-emptively restrained the media from publishing any further statement issued by J. Karnan. If J. Karnan were to say tomorrow that he was being harassed, drugged or poisoned, will the media not be allowed to report this. Has J. Karnan being sentenced to civil and social exile or death? And what about the free speech rights of J. Karnan and the rights of the press to report about his future circumstances and actions and the rights of the public to know the fate and thoughts of J. Karnan. The Supreme Court has gagged the Press to protect itself from scrutiny over the J. Karnan matter."

Presently, I am being poisoned in my car outside gate 8 of the Delhi High Court where I am sleeping at night. I am being targeted more since the last one month. Acrid fumes, acidic fumes, poisonous gases, nerve agents and some anesthetic gas is being released near me. I was targeted with these chemicals over the last three nights. The intent was to cause death. 

For the last four weeks, I am being targeted with chemicals which are causing toxic neuropathological symptoms. I am experiencing a burning sensation in my right thigh. Plus my right thigh and hands and fingers become transiently numb after these chemical attacks. 

I am also experiencing breathlessness and squeezing in the heart because of this poisoning. Other recent symptoms include a burning sensation in my lungs. 

I shared this information with lawyer Arvind Nigam. Since then, the targeting has increased leading me to believe he shared my confidence with those lawyers involved in targeting me. A few days ago, Mr Arvind Nigam also attempted to cover up the fact that I was being targeted by poisonous chemical fumes being sprayed into or near my eyes. 

I was again targeted and physically attacked by DLF Promenade Security malls this morning. Please see the emails reproduced below. 

I am sitting at the Starbucks in Ambience Mall in Vasant Kunj and am being targeted here as well. 

Jeffrey Immelt, John Flannery and Alexander Dimitrief of General Electric Company are responsible for me being poisoned. Persons within the Modi administration and the BJP who are having me targeted include Narendra Modi, Amit Shah, Arun Jaitley, Suresh Prabhu and Ajit Doval. Powerful former ministers/ officials having me targeted include Manmohan Singh and Montek Singh Ahluwalia. Pratyush Kumar (ex-GE) and now heading Boeing in India is also having me targeted. Soli Sorabjee and Zia Mody are also involved in targeting me. 

The intent is to prevent me from pursuing my corruption and fraud complaints against GE in the Supreme Court of India and to prevent me from having my contempt appeal heard and to prevent me from appearing before the Supreme Court in my matter. 

want to record that when I was staying at the Dragon House Hotel in Majnu Ka Tila in December 2016 and January 2017, I was being targeted by highly poisonous chemical fumes, gases and pesticides which were being released into my room daily and nightly and which I was complaining about. 

While I was staying there, my hair had started to fall out in clumps. During and shortly after that time, over a period of two months, a large amount of my hair also turned grey. Photographs of me will confirm that significant graying of hair occurred over a very short period of 1-2 months as a result of my being poisoned at Dragon House in Majnu ka Tila. Several poisons cause hair loss. I also have photographs of my hair falling out. 

I was similarly targeted when I was staying at the Lutyens Guest House on Prithviraj Road in 2016. My hair was falling out then too. The owners of this guest-house, I recently discovered, are long-term clients of Mr A S Chandhiok. I was both drugged and poisoned there. 

A forensic examination of my hair and nails and other body tissues and organs will establish this poisoning. 

Because of being chronically poisoned since 2010, I have lost over two-thirds of the density of hair on my head. 

My hair stopped falling out after I left the Dragon House hotel.

This morning I was again targeted by security guards in DLF Promenade Mall when I was walking through it on my way to Ambience mall. 

Pictures of the men involved are attached. 

Two security guards were waiting for me at the elevator. 

One security guard at the connecting passage between DLF Promenade and Ambience Malls, again physically assaulted me. He followed me, attempted to physically grab me and then blocked my entrance to Ambience Mall standing before me and physically stopping me from opening the door. A man in a white shirt and black trousers was also involved. Two other men were also present and involved. 

This was again a planned and coordinated attack and this will be established by the CCTV cameras. 

After the assault on me on 18 April, I had met the DLF Emporio operations manager and the DLF Promenade General Manager the next day in the DLF Emporio Mall. They assured me this would not happen again and that they would take action against the security guards who assaulted me. 

Instead the same thing was attempted today. 

The security guard who followed me for about 100 meters and who physically restrained me today also targeted me with some highly poisonous chemical fumes. 

Two security guards in DLF Emporio Mall were also involved. Their pictures are attached.

An FIR must be registered against the Policemen and DLF Promenade Mall security and staff and any others involved in the physical assault on me last night. 

The facts are these. I am a regular visitor to the Mall. I am a whistleblower exposing corruption, fraud and forgery by General Electric Company in connection with the Rail Ministry's diesel locomotive factory Project at Marhowra. I am now fighting this corruption battle in the Supreme Court of India. A copy of my CV is attached. 

On multiple past visits, I have been targeted with poisonous chemicals at DLF Promenade Mall. I have when possible taken pictures of those involved and made police complaints on email. Mall staff and security guards have been involved as are certain policemen. 

Yesterday, I was walking through DLF Promenade Mall on my way out, I was first insulted and abused by 5 men at the security post between Ambience and DLF Promenade Malls. 

On my way out, I was threatened by the security guards at the main gate. 

I told these men that I was within my rights to take a picture of someone targeting me and to send that to the Police with a complaint. I told these men that I would only talk to the Mall management. 

Two policemen in plainclothes who were clearly involved in this conspiracy to target me arrived. I told them the gist of the matter. They threatened me with the Police. They asked the guards to detain me. With what authority of law? I am making email complaints to the Police which are being ignored. I will move the Supreme Court for the registration of FIRs including against involved policemen. 

These men attempted to cover up my complaint of targeting by using the same policemen who are obviously involved in targeting me. 

It appears as if there was an intent to use the policemen waiting outside to physically harm me. 

After I took pictures of these men, I was ordered by them to delete those pictures. By what authority of law? 

These men and several others followed me outside the Mall to the main road. There in front of at least 5 policemen, one of these men ordered two female mall security guards to assault me and to snatch my phone. Two women jumped upon me and physically grabbed me and twisted my arm and tried to remove my phone from my hand. 

By what authority of law did these security guards use physical force against me and even touch me. What were the watching policemen doing? I was bruised and scratched and would have fallen to the ground. I was saved because three women passers-by came to my help. The female security guard can be heard telling these women to leave in the audio recording. 

After the women let go of me for a few minutes, a policeman came up to me. I asked him how I was attacked in his presence. Instead of helping me, he started threatening me and was aggressive and rude toward me. 

After this I was again grabbed and physically assaulted by the security guards on the instructions of this uniformed policeman. Then the passers-by appeared and with their help I managed to get away. 

There must be CCTV cameras even covering this section of the main road and the physical assault on me must have been captured by these cameras. 

I was illegally confined. I was physically threatened and physically assaulted. Attempts were made to snatch and destroy my phone. It appears as if the larger conspiracy was to abduct me after destroying my phone. 

An FIR needs to to registered against the persons involved. If it is not registered, I will be moving the Supreme Court of India seeking directions for the registration of an FIR.

As I was leaving Ambience Mall through the DLF Promenade Mall, I was brutally attacked outside DLF Promenade Mall by its security guards in the presence and on the instructions of policemen who were on the spot. Two plainclothes policemen were also involved.

Attempts were made to first detain me. And then to seize my phone. Two female security guards on the instructions of the policemen wrestled with me for my phone. I was brutally bruised.

I was saved only because three women passing by saw the commotion and came forward to help me.

I will be sending a detailed complaint tomorrow.
