The way I was targeted using doctors in the AIIMS trauma center and the AIIMS emergency department because I am a whistleblower exposing corruption and fraud by GE, has been seen earlier. It is part of an obvious pattern.

I woke up this morning feeling very well. There was no fever and no weakness. I left the hotel I was in and drove to a mall. I was fine yesterday and last night too. Yesterday and the day before I had very slight fever. 

Some highly poisonous chemical has been introduced into my car. This chemical was in my car on the 29th of August also. (I also drove my car on 29 Aug for about 40 minutes before I fell ill)  It  appears as if it is being released in gaseous form from the steering area when I turn or when I brake. 

Today. this chemical caused sudden acute weakness, dizziness, a short period of very intense sweating, high heart rate etc. I sat down somewhere and after about an hour I am feeling better, though I am still sweating. It also caused sudden thirst.

She was taken to Artemis Hospital in Gurgaon and three doctors on that day confirmed only an un-displaced fibula fracture which did not require surgical intervention. Her left leg was placed in a cast. It was confirmed to Ms Sapra that there was no ankle injury.

On 9 June 2014, Seema Sapra went to Fortis Hospital in Vasant Kunj and was told by Dr Anuj Malhotra that her cast needed to be removed for another X-ray. While removing the cast, Dr Anuj Malhotra suddenly twisted Ms. Sapra's left ankle and deliberately dislocated it. She had another X-Ray and then Dr Anuj Malhotra and Dr Pradip Sharma told her that she needed surgery. Ms Sapra repeated her complaint that Dr Anuj Malhotra had twisted her ankle and damaged it, she refused surgery and left Fortis Hospital wearing an Aircast boot on her left leg.

What the doctors who conspired to harm Ms Seema Sapra did not count on was that she was audio-recording her interaction with them.

The evidence that Dr. Anuj Malhotra deliberately dislocated Ms Sapra's left ankle on 9 June 2014 includes the following:

On 30 July 2014, Seema Sapra went back to Fortis Hospital where Dr Anuj Malhotra again suppressed the dislocated ankle and told Ms Sapra that her fracture was healing well.

On 4 August 2014, Ms Seema Sapra consulted Dr Prateek Gupta at Gangaram Hospital who first disclosed to Ms Sapra that her left ankle was dislocated. By then the swelling had reduced and the abnormal position of the bones at the ankle joint were visible.

General Electric Company whistleblower

I am a lawyer with an impressive CV who worked with General Electric Company (GE) in 2010 and who after becoming aware of corruption and fraud committed by GE executives in connection with the multi-billion USD Rail locomotive factory Project at Marhowra, made corruption complaints as a whistleblower.

This letter is being written in response to events of 29th to 1 September 2016, when I was in the AIIMS emergency department with very high fever (103) and extreme weakness because of being poisoned with a sweet smelling gas in my B&B accommodation on 29 August.

Facing a threat to my life, I had filed Writ Petition Civil No. 1280/2012 in the Delhi High Court, titled – Seema Sapra v. General Electric Company and Others, in which notice was also issued to the PMO, the Delhi Police, the CBI, the CVC, and the Railway Ministry. At least 4 court orders were issued in this matter directing the Delhi Police Commissioner to provide me protection, none of which were complied with.

I have faced the most vicious retaliation because of my whistleblower complaints. I have been drugged, poisoned and exposed to toxic chemicals and toxic chemical fumes and gases. I am being chronically poisoned. I have also been rendered homeless. My left ankle was deliberately dislocated after a fibula fracture. I am also being defamed.

One of the most vicious methods of retaliation directed at corporate whistleblowers (like me) or political dissidents, is to falsely label them mentally ill. This is referred to in whistleblower literature as psychiatric retaliation or punitive psychiatry. Attempts have been made by persons acting for GE to falsely label me mentally ill since 2012, but these have all been unsuccessful since my whistleblower complaints, my court pleadings, the evidence that I have produced of corruption and fraud by GE, and the evidence that I have produced of physical and other harm being caused to me establish the truth about me.

My writ petition in the Delhi High Court was unfortunately dismissed in March 2015 by a wrong judgment. I continued to be harmed thereafter. In December 2015, the same two Judge Bench of the Delhi High Court that wrongly dismissed my case against GE, found me guilty of contempt of court in a connected matter and directed that I be punished with imprisonment for a period of one month.  I have filed an appeal against this judgment before the Supreme Court of India. A copy of this appeal is attached.

I intend to file a writ petition before the Supreme Court of India under Article 32 seeking protection of my right to life and other fundamental rights.

I have also made whistleblower complaints against GE with US authorities including the Department of Justice, the SEC and the FBI.

Hon'ble The Chief Justice of India and His Companion Judges of the Supreme Court of India., the appeal/ petition of the Appellant/ Petitioner most respectfully showeth :-

1.       This is a Criminal Appeal under Section 19(1) of the Contempt of Courts Act, 1971 from the judgment dated 17.12.2015 of the Delhi High Court in CONT. CAS(CRL) 2/2014, hereinafter referred to as the impugned judgment. This appeal is filed with a delay of  32  days beyond the 60-day period prescribed in Section 19. An application for condonation of delay is also filed. The impugned judgment dated 17.12.2015 of the Delhi High Court in CONT. CAS(CRL) 2/2014 (Court on its own motion vs. Seema Sapra) is annexed hereto as Annexure A-1. 

2.       By the impugned judgment, the appellant has been found guilty of contempt of court. The impugned judgment has imposed a punishment of imprisonment for a period of one month; and in addition a fine of Rs. 2,000/- to be deposited within a period of three months with the Registrar General of the Delhi High Court failing which the appellant will undergo a further term of imprisonment of one month. The impugned judgment has further directed that the appellant, an advocate enrolled with the Bar Council of Delhi will not be allowed to argue, whether as an Advocate or in person, except in her defence, before any Bench of this High Court or any court or tribunal subordinate to this High Court for a period of two years. The impugned judgment has directed that a copy of that judgment be sent to the Registry of the Delhi High Court and to all subordinate courts and tribunals, and further that a copy of that judgment be also sent to the Delhi Bar Council for information. The impugned judgment itself directed that the operative part pertaining to imposition of punishment would not operate for a period of three months from 17.12.2015 to enable the "contemnor" to take appropriate steps to exercise her legal remedy.

 

3.       This appeal being filed in person by the appellant begins with a prayer, because the only reason that the appellant-whistleblower-advocate has survived almost six complete years of on-going attempts to eliminate her is because of her prayers.

"Sada durga dahine, sanmukh rahe ganesh, panch dev raksha kare, brahma vishnu mahesh."

4.       At the outset, the appellant/petitioner states that being a woman lawyer, she has the greatest respect for both the judiciary and the rule of law. As a whistleblower who complied with her ethical duty of upholding the rule of law even under grave life threats, it is evident that the appellant takes the law seriously. The appellant holds the judiciary and the judicial function in great respect. She has never sought and will never seek a confrontation with the judiciary. She has never intended to scandalize or to disrespect the judiciary or the Court or to bring it into disrepute. 

5.       This appeal challenging a judgment of the Delhi High Court in a criminal contempt proceeding has its genesis in a whistleblower right to life petition that the appellant had filed in the Delhi High Court i.e., Writ Petition Civil No. 1280/ 2012 in the matter of Seema Sapra v. General Electric Company and Others (hereinafter referred to as the "Writ Petition"). 
6.       This appeal will establish that the appellant is a whistleblower, a lawyer who worked in 2010 for General Electric Company in India and who was compelled to make whistleblower complaints when her legal services were sought to be used for corrupt practices including fraud, forgery, bribery, illegal lobbying etc. in connection with Indian Railway tenders for rail locomotive factories at Marhowra and Madhepura. This appeal will establish that attempts were made to eliminate the appellant with State authorities including the Police and intelligence agencies being used to target and silence the appellant. The appellant managed to file an Article 226 petition in the Delhi High Court. This appeal will establish that this petition languished unheard in the Delhi High Court for 3 years while the appellant continued to be destroyed, physically harmed, attacked, intimidated, harassed, targeted and threatened. This Appeal will establish that a Division Bench of the Delhi High Court wrongfully dismissed that Petition by a judgment dated 2.3.2015 without hearing the appellant who was the petitioner in that matter in complete violation of the principles of natural justice. This appeal will establish that the Division Bench of the Delhi High Court wrongfully dismissed the whistleblower corruption case against General Electric Company in complete disregard of the material on record before it, in complete disregard of the law and in complete disregard of the appellant's right to life. This appeal will establish that this unsustainable and wrongful dismissal of the writ petition resulted in a cover-up of very serious complaints and evidence of corruption by and favouring General Electric Company facilitated by then Prime Minister Dr Manmohan Singh and his close aide and then Deputy Chairman of the Planning Commission Mr Montek Singh Ahluwalia. This appeal will establish that the wrongful dismissal of the Writ Petition and the denial of a hearing to the appellant in that matter resulted in gross injustice, and a cover up of attempts to murder the appellant, a cover-up of the fact that the appellant was poisoned, a cover-up of State and police participation in the conspiracy and attempts to silence and eliminate the appellant, a cover-up of the severe targeting that the appellant was subjected to and a cover up of the gross violation of the appellant's right to life. This appeal will establish that the wrongful dismissal of the Writ Petition has resulted in the appellant continuing to be poisoned for the last one year since 2.3.2015, and continuing to be targeted, harassed, intimidated, threatened, defamed and destroyed.  This appeal will further establish that a mind-boggling fraud was perpetrated on the Delhi High Court in Writ Petition Civil 1280/ 2012 where an unauthorized person effectively impersonated as the authorised signatory of General Electric Company and two of its subsidiaries and filed patently false and unauthorized affidavits and that the wrongful dismissal of the Writ Petition results in a cover up of this massive fraud on the Court. This appeal will further establish that affidavits filed for the Railway Ministry in the Writ Petition contained multiple instances of perjury and included documents fabricated expressly for the purpose of covering up the corruption by General Electric. Further this appeal will establish that affidavits and status reports filed for the Delhi Police in the Writ petition also contained multiple instances of perjury, and that these affidavits and status reports themselves establish that the police was targeting the appellant and besides actively facilitating her being physically harmed, the police covered up her complaints and fabricated and procured false complaints against her.

7.       The same Division Bench of the Delhi High Court which dismissed the Writ Petition ( Justice Valmiki Mehta and Justice P.S. Teji) then proceeded to hear two criminal contempt proceedings which were instituted against the appellant while the Writ Petition was pending and which arose out of facts connected to the hearing of the Writ Petition. This same Division Bench has now after rejecting the appellant's request for recusal, ruled against the appellant in one of the contempt cases and again without permitting the appellant to file a written reply, without hearing the appellant or affording her an opportunity to defend herself has issued the impugned judgment holding the appellant guilty of contempt of court and imposing an extraordinarily harsh punishment on the appellant which includes sentencing her to imprisonment.

8.       The appellant states that she has managed to survive for 6 years fighting alone but it is certain that she will be drugged and poisoned in prison and will come out from prison both mentally and physically damaged and incapacitated. It is also certain that this incarceration will be used to falsify medical records for the appellant and to cover up the fact that she has been chronically poisoned, and that this poisoning has caused organ damage and to cover up the fact that the appellant's left ankle was deliberately dislocated in June 2014. The impugned judgment will result in facilitation of the elimination of the whistleblower appellant and in silencing her.

9.       This appeal will establish that the impugned judgment in the contempt case is wrong in law and on facts, that it has been issued in violation of the principles of natural justice and without hearing the appellant and without providing her even the most limited opportunity to defend herself. This appeal will establish that the impugned contempt judgment misrecords not only the facts but also the appellant's submissions and defence. This appeal will establish that the impugned judgment is contrary to law and to the relevant material before the court.

10.     The appellant does not want to comment on the conduct of the specific Division Bench of the Delhi High Court, but this appeal will establish that the judgments of this particular Division Bench both in the Writ Petition and in the contempt case are wrong, contrary to law and to the material on record, and are unsustainable and perverse.

 

11.     The record of Writ Petition Civil No. 1280/2012 is relevant to this appeal but is very voluminous. The appellant will place the record of the writ petition before this Hon'ble Court in electronic format on a DVD.

15.     Before addressing the impugned judgment in the contempt matter, it is important to emphasize that the appellant is a whisteblower facing a serious life threat. Not only does she have a dislocated ankle at present, she has also been chronically poisoned since 2010. The petitioner has been subjected to poisonous chemical fumes/ gases and inhalants and this has increased in intensity over the last one year and the last few months and days. The petitioner's lungs have been damaged and are in a worse condition than that of a Bhopal gas survivor. Other internal organs and body systems have also likely suffered damage from the chronic poisoning. The petitioner's hair and nails can be tested to establish such chronic poisoning.

16.     The genesis of the matter - The appellant worked as in-house counsel for General Electric Company's business division GE Transportation in India in 2010. She was advising General Electric on its bids for two multi-billion dollar tenders floated by the Railway Ministry to set up diesel and electric locomotive factories and for long-term purchase orders for locomotives. During the course of her work the Appellant discovered multiple instances of corrupt and criminal activities that General Electric executives were engaged in as part of their efforts to secure the tender for the diesel locomotive factory at Marhowra. The Appellant became a threat to these General Electric executives and lawyers and she was drugged. The Appellant raised compliance related concerns during her employment with General Electric as a whistleblower and this resulted in retaliation including the wrongful termination of her contract in complete violation of General Electric's own internal policies. The Appellant continued to pursue her complaints even after her contract was terminated and reported the violations to the relevant authorities both in India and in the United States. The appellant continued to be poisoned and drugged while General Electric in a sham internal investigation covered up the appellant's complaints. All through 2011 and through January and February 2012 the appellant was drugged, poisoned, and isolated. Finally, in February 2012, the appellant managed to file Writ Petition Civil No. 1280/ 2012 in the Delhi High Court.

 

 

I am being chronically poisoned. For the last few years, I am being exposed to toxic chemical fumes and gases including pesticides and organophosphates. I am being exposed to different poisons. Since I have filed my appeal before the Supreme Court setting out evidence of GE fraud and corruption, the poisoning has intensified. Poisonous gases and fumes are being introduced into my accommodation and into my car on a daily basis. I am also being sprayed with toxic fumes in public places.

My symptoms have included facial swelling, neck swelling, squeezing in the heart, tightness and pain in chest and upper back, lower back pain, headache, irritation in eyes and skin, redness on outside of eye, numbness in right leg and little finger of right hand, breathing difficulties, breathlessness, sudden acute dizziness and weakness, irritation in abdomen, severe reactive asthma, kidney pain, edema, swollen and painful lymph nodes in neck, pain in upper abdomen right under the breasts caused by bending forward, hair-fall, nail fissures, nausea, sudden bowel movement, sudden extreme thirst, waking up breathless, droopy eyelids upon waking up, weakness in legs, vomiting, stiffness in mouth, facial redness, involuntary urine discharge, pain in right arm, long periods of intense coughing depending upon the kind of fumes I am targeted with.

I am also being poisoned with anesthetic gases introduced into my accommodation which make me sleepy and unconscious. I have been poisoned with gaseous substances while asleep. I have also been repeatedly exposed to some poison (gaseous) that has caused temporary blurred vision.

My heart, kidneys, lungs and other internal organs and systems have been damaged.

This kind of daily targeting with toxic chemicals is a form of physical torture designed to destroy my health through chronic poisoning. It also amounts to mental torture designed to break me mentally.

I am not mentally ill. I have never tried to harm myself and I would never do so. Similarly, I would never harm anyone else. I am neither a threat to myself nor to anyone else. I am homeless because I am being targeted. My appeal before the Supreme Court a copy of which is attached clearly establishes that I am not mentally ill, but that I am making very serious complaints of corruption and fraud against General Electric Company as a whistleblower. This appeal before the Supreme Court of India provides the true facts about me, my situation as a whistleblower, my complaint of chronic poisoning, and evidence of my corruption and fraud complaints against GE. On 29 Aug, a sweet smelling gas was released into my room from 5 am till 2 pm. I got very high fever, headache and extreme weakness. I was unable to walk at times without assistance. I went to the AIIMS trauma Centre in the evening of 29 August because I knew it would be easier to get attention there. They sent me to AIIMS emergency department early in the morning of 30 August 2016. My temperature was 103 and my heart rate was 124. 

At the AIIMS trauma Centre I was first given a bed and a blanket. At one point I went to the toilet and when I retuned found that my bed had been given to someone else. I was rudely told to sit in a chair with 103 temperature in the middle of the night. I was finally given a bed and blanket again. One policeman in plainclothes came to see me at the AIIMS trauma Centre accompanied by another man in civilian clothes. He told me his name was Amit Kumar. I refused to talk to him because he was not in uniform. He later returned with a policeman in uniform who I was told was Gaurav Singh. I informed them that my written complaint of poisoning was already sent to the Police Commissioner and the GKI SHO on email. At 4 am I was woken up by two men loudly shouting across the hall – "Who is accompanying Seema Sapra?" The doctors and nurses knew I was alone. I had no energy to respond. Then the nurse told me I was to be sent to AIIMS emergency. This was around 4.30 am to 5 am. I asked that I be allowed to rest till 7 am. Basically I was not even allowed to get proper sleep and rest during the night I spent at the AIIMS trauma Centre. I was given only a few more minutes to rest and then I was sent to the AIIMS emergency in an ambulance along with an orderly.

When I was brought to the AIIMS emergency department, I was first attended to by Dr Naman, who was the CMO on duty. Despite my request that I be given a bed, I was placed on a very high and narrow trolley that I could only climb onto using a chair and with the assistance of 2 men. Several blood samples were taken, I was asked to give a urine sample, and a nurse placed a paracetamol bottle and a fluid bag in my hands and I was rolled away to a corridor outside which I was told was for fever patients. I got no assistance from any nurse or doctor in this corridor. When I tried to get off the trolley to visit the bathroom, I fell down and was saved from falling onto a smaller trolley placed next to me. I have a huge bruise on my right arm from this fall. I got the urine sample but the doctors and nurse refused to accept it. I was forced to walk around with 103 fever until I deposited it in the right place. I then discovered that my prescription document was missing and a nurse told me that she could not administer the Paracetamol and fluid until she saw the prescription. I went inside the emergency unit to the doctors table and met Dr Souvik. I discovered a woman orderly had walked off with my prescription. Dr Souvik told me to go lie down on bed 48. I went there but it was occupied. The last bed in the central passage of the emergency unit was vacant. Having no energy and being weak, I lay down on it. Despite having high fever, despite feeling cold and shivering and despite repeated requests including to Dr Naman and other doctors and nurses, I was not provided a blanket or even a sheet to cover myself. I lay on this bed the entire day. A doctor came and saw me. Some nurses administered the paracetamol. Two nurses finally came after lunch-time and I was told that instead of the fluid bag handed over to me earlier, two fluid bottles were to be administered. They left after setting up one fluid bottle to be intravenously administered. Please note that this bottle was leaking. The fluid was not moving and I repeatedly pointed this out to nurses who ignored this. One nurse finally replaced the unused bottle with another. The fluid in this bottle moved for a while but then stopped moving. A male nurse finally adjusted something in the contraption in my right harm and the bottle eventually emptied though very slowly.

Sometime in the afternoon a male doctor came to my bed, picked up my patient record and took it away. When I went to the doctor/ nurse station to ask for it, I was told I could not have it or even look at it and that it would remain with a nurse.

I was trying to go to sleep for the night around 9 pm, when some male nurses and security guards started to harass me. I was told I had to vacate the bed and move onto a trolley as the bed was for admitted patients only. I told them that the CMO Dr. Souvik had asked me to occupy a bed and that I would only vacate it if the CMO asked me to. I had very high fever and zero energy, it was an MLC case and I was unattended. They harassed me for about 2 hours and once even threatened me using a security guard but refused to call the CMO. Finally, at around 11 pm they left me alone. I had just fallen asleep when a doctor woke me up. I asked him why my doctors kept changing. I think this was the consultant on duty Dr. Prakash or Dr. Pratap. He left without any examination. I went back to sleep and was again woken up at around midnight by a male nurse telling me he wanted to administer a fluid bottle and it would only take half an hour. I told him I needed to sleep and that the earlier bottle had taken 4 hours to empty and that this could now be done in the morning.

The next morning (31 August), I was woken up at 4 am by a man who tried to get me to take a pill saying it was for a gastric issue. I refused saying that I had no gastric issue. He lied to me that he was a doctor.

By 6 am again, some male nurses and security guards started to pressure me to vacate the bed. I again requested that they call the CMO, which they refused. I went to the bathroom and when I returned I was not allowed to occupy the bed. A man identifying himself as the CMO finally came there and I was shifted to an empty bed in the isolation area. I was there for a couple of hours when I was shifted to another bed in the central cubicle area. However, there was a very strong phenyl smell near the head of the bed. I met Dr. Murmu the Consultant on duty, told him about my GE whistleblower background, my complaint of chronic poisoning, told him my lungs were damaged and that I could not tolerate the phenyl smell. He told Dr. Gaurav to get me another bed. I was then shifted to a bed in one of the red areas.

On 31 August morning, when I again requested to read my patient record, I was told I could not. I then wrote down my complaint of chronic poisoning and symptoms on a piece of paper. I met Dr Murmu, he read it. He advised me to get an appointment with a doctor in the Medicine Department who specialized in poisoning who could then have me investigated for chronic poisoning. He told Dr. Gaurav to get a Senior Resident from medicine to meet me.

Dr Murmu also arranged for me to see my patient record. I was shocked to find that a false record had been created that read "poisoning by herself" and which suggested reference to psychiatry. I pointed out to Dr. Gaurav and other doctors that this was false and that I would not see a psychiatrist.

I was sitting on my assigned bed when a male doctor came and told me he was a senior resident from Medicine. I told him I had a complaint of chronic poisoning. He left almost immediately.

A young lady doctor then came up and started speaking to me. She told me she was Dr Nishtha. I asked her what department she was from and she said she was from medicine. I asked her for her email and she wrote it down for me as nishtha.aiims@gmail.com

She spoke to me for about 5 -7 minutes. I told her I was a lawyer who was fighting a corruption case against General Electric Company and that I had a complaint of chronic poisoning. I read out my symptom list for her and also emailed it to her. She asked me about my family and I told her I was not in touch with them. I told her I was homeless. I mentioned my Supreme Court appeal. I told her about my dislocated ankle. She asked me to walk for her I did. She asked me some questions in the end about the date and time. I answered correctly. She then left telling me she would add her notes. The whole time I was polite to her. She asked me if I would agree to talk to a psychiatrist. I said no.

After sometime I got to read my patient record again, and I found that Dr. Nishtha had lied to me. She is a Junior Resident in the psychiatry department and she appended a note to my patient record recommending that I be transferred to IHBAS.

My complaint is of chronic poisoning because of my whistleblower corruption complaints against General Electric Company. I filed Writ Petition Civil No. 1280 of 2012. Evidence of my whistleblower corruption complaints is before the Supreme Court of India in my attached appeal in a connected matter. My complaint of chronic poisoning is also before the Supreme Court. My complaint of homelessness is also before the Supreme Court. This is what I informed Dr Nishtha. Instead of recording these facts, Dr Nishtha falsified facts about me and wrote in her notes:

"She came to AIIMS trauma centre on 30 Aug 2016 and alleged she was being poisoned chronically by some personnels in govt."  

"Pt claims to be fighting a case against General election committee because of which they are all against her (? Persecutory Delusion)

She then writes:

"MSE Irritable affect

? Persecutory Delusion"

 

Dr Nishtha then notes in her advice -

"For any psychiatric diagnosis, corroboration from a close relative/ family member/ friend is required or a longitudinal observation reqd. (Pt is not providing contact no of any relative). Patient is unattended currently so, kindly refer to IHBAS (for longitudinal observation) (after fever) has been adequately managed."

 

She also notes:

"No psychotropics should be started in view of uncertain psychiatric history and ongoing fever".

At no point did Dr Nishtha ask me any psychiatry oriented questions. She specifically did not ask me if I heard voices. Or if I had thought of suicide. Or if I had a drug history. For the record, I do not hear voices, I have never considered suicide and I have never consumed drugs. But as her notes show Dr. Nishtha entirely fabricated this part of the conversation.

After reading Dr Nishtha's notes falsifying my complaint and attempting to falsely label me mentally ill, I told doctors at the AIIMS Emergency that I was not mentally ill and that I would not go to IHBAS.

Unknown to me and without prior discussion with me, doctors at the AIIMS emergency had already prepared and placed on my patient record two computer printed slips for my transfer to IHBAS. These were dated 12.15 pm and one was signed by a Dr Ranjan. I saw these only the next day on 1 September.

I kept lying down on my assigned bed. At one point an orderly came to me saying I was to be transferred to another hospital. I said I had refused such a transfer.

Dr Naman then repeatedly told me that I was free to leave. I told him that I still had high fever and was weak and would leave in the morning.

Later another Emergency consultant Dr, Meera Ekka came to see me. I apprised her of what my complaint was and what was going on. Around that time, a patient who was vomiting large quantities of blood was placed next to me. I was forced to vacate my assigned bed to avoid being splattered with blood. Dr. Meera then told me that I could occupy one of the free beds in the isolation room. I spent the night on this bed. At one point during the night a drunk man was placed next to me. He and his attendants were very noisy so I spent about 2 hours awake in the middle of the night. I then moved to a corner bed in the isolation room where I was finally able to get some rest and sleep.

Dr Meera had provided me the email contact for the AIIMS emergency department. I had by then emailed the Emergency department about what was going on.

The next morning, Dr. Naman again lied to me that I had been discharged whereas I had not been discharged/. He tried to get me to leave without a formal discharge. If I had left, AIIMS doctors would have informed the police that I had left without being discharged The Police would have picked me up and would have forcibly taken me to IHBAS. Dr Naman deliberately and repeatedly misled me that I had been discharged when I had not been discharged. He tried to trick me into leaving without a discharge.

Dr. Naman also refused to let me read my papers.  He also refused to give me copies of my patient record upon discharge.

I met Dr. Tahir M. Ansari who was the consultant on duty in the emergency on 1 September. With Dr Tahir's intervention I got to read my patient record. Dr Tahir also asked Dr Naman to issue me discharge papers so I could leave and to give me my patient record.

Dr Naman also lied to me that the Head of Department of the AIIMS Emergency unit was on leave. He was not and I later met and spoke at length to Dr. Praveen Aggarwal, Professor & Head of the Emergency Department.

Once Dr Naman signed the discharge sheet, I left along with the patient record which was handed over to me by him only after he removed the two sheets prepared for transfer to IHBAS.

What these facts disclose is that not only did doctors at the AIIMS emergency cover up my complaint of poisoning, despite registration of an MLC, they did not carry out mandatory tests in a poisoning MLC (including urine toxicology and other relevant blood tests), they falsified medical and legal MLC records, they denied me treatment for poisoning, and then they attempted to have me illegally committed to IHBAS under false evidence.

 

Dr Nishtha, the Junior Resident who spoke to me without my consent and after unethically lying to me that she was from the medicine department at AIIMS, is not even a psychiatrist. She appears to be an MD student at AIIMS studying psychiatry. She is not even medically qualified or licensed to practice as a psychiatrist or to form any kind of opinion as to anyone's psychiatric condition. She was used by the relevant doctors at AIIMS to commit several criminal offences including the relevant IPC provision which makes it a criminal offence to have someone committed to a psychiatric institution on fraudulent grounds or without legal cause.

 

Also, her opinion is worthless because she did not even comprehend as is evident from her note that my corruption battle is against General Electric Company (GE) a Fortune 500 company and not as Dr Nishtha notes - some "general election committee". So a whistleblower exposing corruption and fraud by GE and complaining of poisoning and falling ill as a result is according to the weird logic of a "psychiatry student" (Dr Nishtha), "possibly" suffering from "persecutory delusions". Not only is this opinion of Dr Nishtha not worth the price of the paper it is written on, she is guilty of medical malpractice.

It is obvious that Dr Nishtha deliberately falsified facts about me in her notes and this was intended to support her false attempted labelling of me as mentally ill and as suffering from persecutory delusions. Dr Nishtha falsified facts about me in her notes with deliberate intent to mislead doctors at IHBAS.

 

What is even more egregious medical malpractice is that doctors in the AIIMS emergency attempted to use Dr Nishtha's "opinion" to transfer me IHBAS.

It goes without saying that GE has immense influence with all hospitals including AIIMS and with doctors.

I discussed this matter with Dr Agarwal, HOD of Emergency Medicine at AIIMS after being discharged. A recording of my conversation with Dr. Aggarwal is attached.

I am disputing Dr Nishtha's notes as false and motivated. She has misrepresented crucial facts about me and has fabricated an account of our conversation. She not only lied to me that she was from the medicine department but she has also falsified our conversation in her notes. She never asked me about whether I heard  voices, or whether I was suicidal etc. All of which she says in her notes I denied. Instead I told her about my background as a GE whistleblower and my complaint of chronic poisoning and my symptoms. I described my dislocated ankle.

 

Please note that the AIIMS papers include no investigation or finding on poisoning. Instead, my complaint of chronic poisoning by gaseous substances was attempted to be falsified as "poisoning by herself". Then a psychiatry junior resident lied to me that she was from medicine and unethically spoke to me on that pretext. She then fabricated our conversation and recommended that I be referred to IHBAS.

I spoke to Dr L R Murmu consultant in the Emergency He told me to get an OPD consultation in the Medicine department at AIIMS with a doctor who specializes in poisoning so that I can access toxicology tests. I intend to do that.

Dr Naman also falsified in my patient records that I am on irregular treatment for hypothyroidism. This is false. I take 125 thyronorm daily.

 

My family is being blackmailed with a domestic violence complaint and a child custody case. They were used to drug and poison me in 2011. I am not in touch with my family since then. I have stated on the court record in Writ Petition Civil 1280/2012 that my family is dead to me and that they should not even be allowed to touch my dead body.

The issue of me being poisoned is pending before the Supreme Court of India. I am fighting a corruption case against GE as a whistleblower. Manmohan Singh and Montek Ahluwalia were involved. I have complained to the Supreme Court that the police are being used to poison me.

 

Dr Nishtha was used to cover up my complaint of poisoning. She calls my complaint of poisoning persecutory self-delusions. On what basis? Until a full toxicology screen is done and until my body is examined for organ damage, poisoning cannot be ruled out. There has neither been any police investigation nor any medical investigation into my complaints of chronic poisoning.

I also point out that a powerful lawyer lobby comprised of powerful men like Soli Sorabjee would like to see me destroyed. Not only did lawyer Zia Mody, Mr Sorabjee's daughter help commit a fraud on the Delhi High Court for GE in my case, but I have also made a sexual harassment and assault complaint against Soli Sorabjee. On 30 August evening, I saw a woman Supreme Court lawyer in the AIIMS emergency. She was in a black, white and red saree with a lawyers blouse. See picture attached. She is visible in the distance. You will need to enlarge the picture.

The doctor who woke me up around just before midnight on 30 August – was he Dr Pratap Sharan from psychiatry.  In the morning the same doctor told me that AIIMS would just keep me under observation for a few more hours. Who was the consultant on duty on the night of 30 August?

Other symptoms of the chronic poisoning with gaseous substances have included waking up breathless, droopy eyelids upon waking up. I have been poisoned with gaseous substances while asleep.

I have also been repeatedly exposed to some poison (gaseous) that has caused blurred vision.

Other symptoms have included weakness in legs, vomiting.

My corruption case against GE was before the High Court for 3 years. At least 4 orders were issued by the Court to the Delhi Police Commissioner directing that I be provided prptection. These orders were never complied with.

I am fighting a corruption case against GE as a whistleblower. Manmohan Singh and Montek Ahluwalia were involved. I have complained to the Supreme Court that the police is being used to poison me.

Dr Murmur told me to go to the Medicine department for toxicology tests.

Dr Nishtha is being used to cover up my complaint of poisoning. She calls my complaint of poisoning persecutory self-delusions. On what basis? Until a full tox screen is done and until my body is examined for organ damage, poisoning cannot be ruled out.

On 29 Aug, a sweet smelling gas was released into my room from 5 am till 2 pm. I got very high fever, headache and extreme weakness. I went to AIIMS trauma Centre because I knew it would be easier to get attention there. They sent me to AIIMS yesterday. I had 103 fever and my pulse was 123.  

Yesterday some resident falsified my complaint of poisoning to a complaint of poisoning by herself. And an attempt is being made to treat this as a psychiatric issue.

At 4 am this morning, a man woke me up and tried to get me to take a pill saying it was for a gastric issue. I said I had no gastric issue. He lied that he was a doctor.

To add to my previous email, I am also being poisoned with anesthetic gases which make me sleepy and unconscious.

Also with pesticides and organophosphates. Other symptoms include nausea and sudden bowel movement.

I am a lawyer who is fighting a corruption case against GE.

For tha last few years, I am being exposed to toxic chemical fumes and gases. I am being exposed to different poisons.

The symptoms have included facial swelling, neck swelling squeezing in the heart. Tightness and pain in chest and upper back, lower back pain, headache, irritation in eyes and skin, redness on outside of eye, numbness in leg and little finger, breathing difficulties. Sudden acute dizziness and weakness, irritation in abdomen, reactive asthma, kidney pain, edema, swollen lymph nodes in neck. Pain in upper abdomen right under breasts, hair-fall, nail fissures, etc.

My heart, kidneys, lungs etc have been damaged.
