today's hearing and matter now listed for tomorrow - Seema Sapra, General Electric whistle-blower - WP Civil 1280 of 2012, a corruption whistle-blower petition in the Delhi High Court (Seema Sapra v General Electric Company and Others)

Writ Petition Civil 1280/ 2012 plus pending applications were listed today in the Delhi High Court. The matter was taken up by the Special Division Bench comprising Judge Sistani and Judge Pathak at around 3:30 pm.

 

I pressed my request for recusal by this Bench (J. Sisani and J. Pathak) which is also one of the prayers in CM which was listed today.

 

Once again Judge Sistani and Judge Pathak openly targeted me, repeatedly prevented me from making my submissions and repeatedly attempted to pass orders in this matter without deciding the recusal prayer.

 

J. Sistani and J. Pathak again attempted to cover up the corruption complaints and my complaints of poisoning, physical harm and threat to life.

 

J. Sistani openly threatened me in a courtroom packed with lawyers today.

 

J. Sistani and J. Pathak attempted to pass an order to avoid the recusal prayer by stating that they would place the application with the recusal prayer before the Delhi High Court Chief Justice.

 

I pointed out to them that Delhi High Court rules and a notification issued under the instructions of the Chief Justice made it absolutely clear that a recusal application was to be decided by the Judge whose recusal was sought.

I also stated in court that the Bench must first pass orders on the recusal request and if this request was declined, then I intended to appeal against such an order to the Supreme Court of India.

I further stated that it would be improper for J. Sistani and J. Pathak to pass any orders in this matter before deciding the request for recusal.

Finally J. Sistani and J. Pathak adjourned the matter to tomorrow (2 December 2014) so that I could produce copy of this notification. This notification dated 3.3.2009 is annexed and copies were given by me to the court-masters of J. Sistani and J. Pathak today after the hearing.

 

The matter has been adjourned to tomorrow. 

 

I also point out that in a connected matter, OMP 647/ 2012, J. Rajiv Sahai Endlaw had by order dated 26 February 2013 listed an application seeking his recusal before the Chief Justice on the administrative side. The Chief Justice had directed that the application for his recusal be sent back and be first placed before J. Endlaw for his decision. J. Endlaw subsequently recused when the application was listed before him again.

 

I clearly told J. Sistani and J. Pathak in court today that I had no faith in them and had sufficient reason to believe that they could not do justice in this matter. I pointed out that natural justice was a constitutional requirement and that these judges had openly displayed bias in the matter towards covering up my complaints.

 

Dr Manmohan Singh and Mr Montek Singh Ahluwalia are involved in the corruption complaints in this writ petition. Both of them are personal friends of Judge Sistani. I have found pictorial proof that spouses of Manmohan Singh and Montek Singh Ahluwalia were present at a party in Judge Sistani's house in 2010.

 

As the decision in the writ petition would personally affect Manmohan Singh and Montek Singh Ahluwalia, Judge Sistani is disqualified from hearing his matter. I rely upon a US decision United States v. Bobo.  I reproduce below an extract from a commentary on Judicial Disqualifcation authored by Charles Gardner Geyh and published by the Federal Judicial Centre (2010).

 

"On the other hand, there may be circumstances in which the ties between the judge and the public official are so close, and the consequences of a ruling adverse to the official are so dire, that disqualification is appropriate regardless of the capacity (if any) in which the official is sued. In United States v. Bobo, an Alabama district judge disqualified himself from hearing a case of interest to the governor because the judge had previously attended private functions endorsing the governor's candidacy. Although the governor was not a party in the case, the outcome of the case could have affected the governor's reelection. To avoid an appearance of bias, the district court concluded that disqualification was appropriate."

 

Even though Montek Singh Ahluwalia is not a party to the writ petition, the consequences of an adverse ruling would be dire for him. J. Sistani must recuse from this matter.

 

I reproduce below some extracts from the pleadings:

 

Paragraph 2 of the Writ Petition states:

"The Petitioner has exposed corruption and malfeasance at the highest levels within General Electric and within the Indian Railways. The complaints made by the Petitioner implicate Dr. Montek Singh Ahluwalia, the Deputy Chairman of the Planning Commission. The Petitioner has seen and has produced documentary evidence in support of her complaints made to the Hon'ble Prime Minister and the Central Vigilance Commission. There is a grave threat to the life of the Petitioner."

 

Paragraph 17 of the Writ Petition states:

"17.     Among other evidence of what happened around GE's failed bid in February 2009, the Petitioner has seen an email sent by GE Transportation employee Mr. Brett Begole to Mr. John Rice, Vice Chairman of Respondent 1 and Mr. Karan Bhatia (another GE lawyer) in February 2009 suggesting that a news report from February 2009 that had hinted at GE's difficulties with the bid be either allowed to die a natural death or that senior Government of India officials (Dr. Montek Singh Ahluwalia and Mr. Ronen Sen, the then Indian Ambassador in Washington) be spoken to. This email was shown to the Petitioner by Mr. Jeffrey Eglash, (a GE attorney appointed by Respondents 11 and 10 to investigate the Petitioner's whistle-blower complaints)  in New Delhi in late 2010 when he met her during a compliance investigation. This email was in a folder compiled by Mr. F Joseph Warin and Mr. John Chesley from Gibson Dunn, a US law firm also allegedly retained by GE to investigate the Petitioner's complaints. This email is suggestive of corruption and demonstrates why GE officers, attorneys and employees might have wanted to prevent their documentary record pertaining to the failed February 2009 bid from being scrutinized by a United States Federal Court."

 

Page 111, 160 of volume 1 of the writ petition also describe Montek Singh Ahluwalia's involvement in the corruption complaints as do the contents of CM 19501/ 2012 and CM 7197/ 2013.

 

Not only does J. Sistani's relationship with Montek Singh Ahluwalia create a reasonable apprehension of bias and of his inability to do justice in this matter, but his and J. Pathak's conduct of court hearings in this matter have provided voluminous evidence of actual bias. These judges have repeatedly attempted to cover up the corruption complaints, have repeatedly targeted me during court hearings, have repeatedly attempted to cover up my complaints of threat to life and poisoning, have delayed hearing of this matter to facilitate my elimination and have repeatedly attempted to sabotage this matter.

Writ Petition Civil 1280/ 2012 plus pending applications were listed today in the Delhi High Court. The matter was taken up by the Special Division Bench comprising Judge Sistani and Judge Pathak at around 3:30 pm.

 

I pressed my request for recusal by this Bench (J. Sisani and J. Pathak) which is also one of the prayers in CM which was listed today.

 

Once again Judge Sistani and Judge Pathak openly targeted me, repeatedly prevented me from making my submissions and repeatedly attempted to pass orders in this matter without deciding the recusal prayer.

 

J. Sistani and J. Pathak again attempted to cover up the corruption complaints and my complaints of poisoning, physical harm and threat to life.

 

J. Sistani openly threatened me in a courtroom packed with lawyers today.

 

J. Sistani and J. Pathak attempted to pass an order to avoid the recusal prayer by stating that they would place the application with the recusal prayer before the Delhi High Court Chief Justice.

 

I pointed out to them that Delhi High Court rules and a notification issued under the instructions of the Chief Justice made it absolutely clear that a recusal application was to be decided by the Judge whose recusal was sought.

I also stated in court that the Bench must first pass orders on the recusal request and if this request was declined, then I intended to appeal against such an order to the Supreme Court of India.

I further stated that it would be improper for J. Sistani and J. Pathak to pass any orders in this matter before deciding the request for recusal.

Finally J. Sistani and J. Pathak adjourned the matter to tomorrow (2 December 2014) so that I could produce copy of this notification. This notification dated 3.3.2009 is annexed and copies were given by me to the court-masters of J. Sistani and J. Pathak today after the hearing.

 

The matter has been adjourned to tomorrow. 

 

I also point out that in a connected matter, OMP 647/ 2012, J. Rajiv Sahai Endlaw had by order dated 26 February 2013 listed an application seeking his recusal before the Chief Justice on the administrative side. The Chief Justice had directed that the application for his recusal be sent back and be first placed before J. Endlaw for his decision. J. Endlaw subsequently recused when the application was listed before him again.

 

I clearly told J. Sistani and J. Pathak in court today that I had no faith in them and had sufficient reason to believe that they could not do justice in this matter. I pointed out that natural justice was a constitutional requirement and that these judges had openly displayed bias in the matter towards covering up my complaints.

 

Dr Manmohan Singh and Mr Montek Singh Ahluwalia are involved in the corruption complaints in this writ petition. Both of them are personal friends of Judge Sistani. I have found pictorial proof that spouses of Manmohan Singh and Montek Singh Ahluwalia were present at a party in Judge Sistani's house in 2010.

 

As the decision in the writ petition would personally affect Manmohan Singh and Montek Singh Ahluwalia, Judge Sistani is disqualified from hearing his matter. I rely upon a US decision United States v. Bobo.  I reproduce below an extract from a commentary on Judicial Disqualifcation authored by Charles Gardner Geyh and published by the Federal Judicial Centre (2010).

 

"On the other hand, there may be circumstances in which the ties between the judge and the public official are so close, and the consequences of a ruling adverse to the official are so dire, that disqualification is appropriate regardless of the capacity (if any) in which the official is sued. In United States v. Bobo, an Alabama district judge disqualified himself from hearing a case of interest to the governor because the judge had previously attended private functions endorsing the governor's candidacy. Although the governor was not a party in the case, the outcome of the case could have affected the governor's reelection. To avoid an appearance of bias, the district court concluded that disqualification was appropriate."

 

Even though Montek Singh Ahluwalia is not a party to the writ petition, the consequences of an adverse ruling would be dire for him. J. Sistani must recuse from this matter.

 

I reproduce below some extracts from the pleadings:

 

Paragraph 2 of the Writ Petition states:

"The Petitioner has exposed corruption and malfeasance at the highest levels within General Electric and within the Indian Railways. The complaints made by the Petitioner implicate Dr. Montek Singh Ahluwalia, the Deputy Chairman of the Planning Commission. The Petitioner has seen and has produced documentary evidence in support of her complaints made to the Hon'ble Prime Minister and the Central Vigilance Commission. There is a grave threat to the life of the Petitioner."

 

Paragraph 17 of the Writ Petition states:

"17.     Among other evidence of what happened around GE's failed bid in February 2009, the Petitioner has seen an email sent by GE Transportation employee Mr. Brett Begole to Mr. John Rice, Vice Chairman of Respondent 1 and Mr. Karan Bhatia (another GE lawyer) in February 2009 suggesting that a news report from February 2009 that had hinted at GE's difficulties with the bid be either allowed to die a natural death or that senior Government of India officials (Dr. Montek Singh Ahluwalia and Mr. Ronen Sen, the then Indian Ambassador in Washington) be spoken to. This email was shown to the Petitioner by Mr. Jeffrey Eglash, (a GE attorney appointed by Respondents 11 and 10 to investigate the Petitioner's whistle-blower complaints)  in New Delhi in late 2010 when he met her during a compliance investigation. This email was in a folder compiled by Mr. F Joseph Warin and Mr. John Chesley from Gibson Dunn, a US law firm also allegedly retained by GE to investigate the Petitioner's complaints. This email is suggestive of corruption and demonstrates why GE officers, attorneys and employees might have wanted to prevent their documentary record pertaining to the failed February 2009 bid from being scrutinized by a United States Federal Court."

 

Page 111, 160 of volume 1 of the writ petition also describe Montek Singh Ahluwalia's involvement in the corruption complaints as do the contents of CM 19501/ 2012 and CM 7197/ 2013.

 

Not only does J. Sistani's relationship with Montek Singh Ahluwalia create a reasonable apprehension of bias and of his inability to do justice in this matter, but his and J. Pathak's conduct of court hearings in this matter have provided voluminous evidence of actual bias. These judges have repeatedly attempted to cover up the corruption complaints, have repeatedly targeted me during court hearings, have repeatedly attempted to cover up my complaints of threat to life and poisoning, have delayed hearing of this matter to facilitate my elimination and have repeatedly attempted to sabotage this matter.
