message dated 12 Nov 2014 from Seema Sapra, General Electric whistle-blower - WP Civil 1280 of 2012, a corruption whistle-blower petition in the Delhi High Court (Seema Sapra v General Electric Company and Others)

Last night I checked into Beyond Hotel in Malwiya Ngr for one night. This is owned by a builder called Nitin Verma. I will be checking out today.

Early this morning around 6:30/7 am, some poisonous chemical was released into my room. I was not harmed because I had the window open and fan on. I did however start to cough. Later, a waiter called Akash was made to call my room at 8 am. When I complained to the man at the front desk who was here all night, he lied that he was the front office manager and that his name was Mukesh. He is actually a front office executive called Ranjan Das. When I asked him to connect me to the hotel manager, he connected me to Shankar another FO executive and lied that it was the manager. Finally, I spoke to Arnab Das who is the hotel manager.

I am a lawyer facing a threat to my life because of a corruption whistle-blower case I have filed against General Electric Company. An order of the Delhi High Court directing the Delhi Police Commissioner to protect me is reproduced below.

I also reproduce two emails I sent yesterday to the Registrar General of the Delhi High Court.

Subject: Court file not sent to Court/Judges for hearing dt 10/11/14 in WPC 1280/ 12 - whistleblower corruption case (Seema Sapra v General Electric Company and Ors.)
To: rg.dhc@nic.in, pmosb <pmosb@gov.in>, dcbi@cbi.gov.in, Bhim Sain Bassi <cp.bsbassi@nic.in>, CHAIRMANOFFICE <CHAIRMANOFFICE@sec.gov>, fcpa.fraud@usdoj.gov, supremecourt@nic.in
Cc: Seema <seema.sapra@gmail.com>

To the Registrar General of the Delhi High Court,

The court file in the captioned matter has 32 volumes.

WPC 1280/12 and all pending applications were listed in Court 24 on 10/11/14 before a Special Division Bench of J. Sistani and J. Pathak.

I have found out that the complete court file was not sent from the registry to the Court/ Judges for this hearing. Only a small part of the file, i.e., Part 1, Part B and the last volume were sent to the Court. Therefore the applications in WPC 1280/12 listed before Court on 10/11/14 were not sent to the Judges to read before the hearing. These applications were also not with the Judges during the hearing on 10/11/14 on the date they were listed. Several crucial affidavits and documents in the 31 volumes that were not sent to Court were not available for the Court hearing. The CDs filed in the matter were also not available for the court hearing.

The same thing also happened on the previous date of hearing in WPC 1280/12 in September 2014 before the same Bench.

Earlier in May 2014, the same thing happened for two hearings when the matter was listed before a Division Bench presided over by J. Sistani. .

This amounts to deliberate sabotage of the court hearings in this high-profile corruption whistle-blower case because of which my life is in danger and because of which I have been and continue to be physically harmed and poisoned.

If J. Sistani and J. Pathak are responsible for this then it amounts to judicial corruption.

Otherwise it is corruption by court officers or registry staff who were bribed to do this with intent to prevent the Judges from reading the court record in the matter.

Both J. Sistani and J. Pathak rely upon the paper files and do not use the electronic copy of the court record in Court.

Please bring this to the attention of the Chief Justice of the Delhi High Court. Please also initiate an inquiry into why the court file was not sent to the Judges and the court from the registry for the court hearing of 10/11/14 and for at least three earlier hearings as stated  above.

Subject: Orders dated 10 Nov 14 passed by J Sistani and J Pathak in WPC 1280/12 and in two connected matters still not signed or uploaded on Delhi High Court website

To the Registrar General of the Delhi High Court,

The orders passed by J Sistani and J Pathak yesterday i.e., on 10 November 2014 have still not been signed and uploaded on the Delhi High Court website.

I remind you that the Code of Civil Procedure requires daily orders to be signed the same day.

I requested J Sistani to have these orders signed and uploaded to the court website, but he refused to expedite this despite the already unlawful delay. J. Sistani is deliberately violating my legal right to read the signed orders today. He is doing this despite knowing that I am coming to court with a dislocated ankle.

Please ensure that these orders are signed and uploaded to the court website today.

I am also concerned that the delay might be used in attempts to falsify these orders.

Today, at the outset, the petitioner made a submission for adjourning the matter as she has made a request to the Chief Justice of India as well as to the Chief Justice of this Court for transfer of this writ petition to the Hon?ble Supreme Court for hearing. We, however, rejected the request for adjournment. So the petitioner has made further submissions in the matter. Due to paucity of time matter is adjourned to 24th January, 2014 for further submission.

Today Mr. Dayan Krishnan, learned counsel for the Delhi Police submitted that on an independent assessment of the situation the police has come to the conclusion that there is no immediate threat perception to the petitioner as she has been projecting every now and then and therefore, now it should be left to the discretion of the police authorities as to whether any protection is to be provided to her or not depending upon the inputs which the police may get. The petitioner strongly refutes this submission. Considering all the facts and circumstances we are not inclined to withdraw our earlier orders directing the police to extend full protection to the life and liberty of the petitioner till further orders of this Court.

Last night I checked into Beyond Hotel in Malwiya Ngr for one night.
This is owned by a builder called Nitin Verma. I am checking out
today.

Early this morning around 6:30/7 am, some poisonous chemical was
released into my room. I was not harmed because I had the window open
and fan on. I did however start to cough. Later, a waiter called Akash
was made to call my room at 8 am. When I complained to the man at the
front desk who was here all night, he lied that he was the front
office manager and that his name was Mukesh. He is actually a front
office executive called Ranjan Das. When I asked him to connect me to
the hotel manager, he connected me to Shankar another FO executive and
lied that it was the manager. Finally, I spoke to Arnab Das who is the
hotel manager.

I am a lawyer facing a threat to my life because of a corruption
whistle-blower case I have filed against General Electric Company. An
order of the Delhi High Court directing the Delhi Police Commissioner
to protect me is reproduced below.

I also reproduce two emails I sent yesterday to the Registrar General
of the Delhi High Court.

Subject: Court file not sent to Court/Judges for hearing dt 10/11/14
in WPC 1280/ 12 - whistleblower corruption case (Seema Sapra v General
Electric Company and Ors.)
To: rg.dhc@nic.in, pmosb <pmosb@gov.in>, dcbi@cbi.gov.in, Bhim Sain
Bassi <cp.bsbassi@nic.in>, CHAIRMANOFFICE <CHAIRMANOFFICE@sec.gov>,

To the Registrar General of the Delhi High Court,

The court file in the captioned matter has 32 volumes.

WPC 1280/12 and all pending applications were listed in Court 24 on
10/11/14 before a Special Division Bench of J. Sistani and J. Pathak.

I have found out that the complete court file was not sent from the
registry to the Court/ Judges for this hearing. Only a small part of
the file, i.e., Part 1, Part B and the last volume were sent to the
Court. Therefore the applications in WPC 1280/12 listed before Court
on 10/11/14 were not sent to the Judges to read before the hearing.
These applications were also not with the Judges during the hearing on
10/11/14 on the date they were listed. Several crucial affidavits and
documents in the 31 volumes that were not sent to Court were not
available for the Court hearing. The CDs filed in the matter were also
not available for the court hearing.

The same thing also happened on the previous date of hearing in WPC
1280/12 in September 2014 before the same Bench.

Earlier in May 2014, the same thing happened for two hearings when the
matter was listed before a Division Bench presided over by J. Sistani.
.

This amounts to deliberate sabotage of the court hearings in this
high-profile corruption whistle-blower case because of which my life
is in danger and because of which I have been and continue to be
physically harmed and poisoned.

If J. Sistani and J. Pathak are responsible for this then it amounts
to judicial corruption.

Otherwise it is corruption by court officers or registry staff who
were bribed to do this with intent to prevent the Judges from reading
the court record in the matter.

Both J. Sistani and J. Pathak rely upon the paper files and do not use
the electronic copy of the court record in Court.

Please bring this to the attention of the Chief Justice of the Delhi
High Court. Please also initiate an inquiry into why the court file
was not sent to the Judges and the court from the registry for the
court hearing of 10/11/14 and for at least three earlier hearings as
stated above.

Subject: Orders dated 10 Nov 14 passed by J Sistani and J Pathak in
WPC 1280/12 and in two connected matters still not signed or uploaded
on Delhi High Court website

To the Registrar General of the Delhi High Court,

The orders passed by J Sistani and J Pathak yesterday i.e., on 10
November 2014 have still not been signed and uploaded on the Delhi
High Court website.

I remind you that the Code of Civil Procedure requires daily orders to
be signed the same day.

I requested J Sistani to have these orders signed and uploaded to the
court website, but he refused to expedite this despite the already
unlawful delay. J. Sistani is deliberately violating my legal right to
read the signed orders today. He is doing this despite knowing that I
am coming to court with a dislocated ankle.

Please ensure that these orders are signed and uploaded to the court
website today.

I am also concerned that the delay might be used in attempts to
falsify these orders.

O R D E R

10.01.2014

Today, at the outset, the petitioner made a submission for adjourning
the matter as she has made a request to the Chief Justice of India as
well as to the Chief Justice of this Court for transfer of this writ
petition to the Hon?ble Supreme Court for hearing. We, however,
rejected the request for adjournment. So the petitioner has made
further submissions in the matter. Due to paucity of time matter is
adjourned to 24th January, 2014 for further submission.

Today Mr. Dayan Krishnan, learned counsel for the Delhi Police
submitted that on an independent assessment of the situation the
police has come to the conclusion that there is no immediate threat
perception to the petitioner as she has been projecting every now and
then and therefore, now it should be left to the discretion of the
police authorities as to whether any protection is to be provided to
her or not depending upon the inputs which the police may get. The
petitioner strongly refutes this submission. Considering all the facts
and circumstances we are not inclined to withdraw our earlier orders
directing the police to extend full protection to the life and liberty
of the petitioner till further orders of this Court.
